Hi everyone.long time since last on here...heres our issue..my girlfriend whi is Thai,works for Disney cruise line,wants a way to come stay with me when her contract is up,can she apply for one in miami and get an answer before she has to go bavk home?she has worked in london and this is her second co.tract for disney...any thoughts?

if she wants to stay for a visit, she need to get a tourist visa from here home country.

i'm assuming she has a working visa for the disney cruise ship? she can't use that visa to change or adjust status inside the us.

Her port is miami....can she apply for it while she is here?my friend in ireland was thai and she apply for tourist visa at US embassy in dublin and got one for US...she wanted to visit after her contract was up on ship...can she go to office in miami and apply there?

Couple of questions. What type of visa is she here on? Does the visa have any home stay at all? Has show had any over stays? From looking at your time line it look like you applied for a K1 back in December. When she has the interview for the K1 that will take place in Bangkok. If you wanted her to get a tourist visa then she would have to apply in Bangkok for that as well unless she already has one.

11-08-2011 Date on text messages but did not receive until 11-22-2011

11-23-2011 Check cashed.

11-25-2011 Hard copies of NOA1s

12-06-2012 Pui's Brother unexpectly passes away and we make an info pass appointment and receive an emergancy AP so she can return home. Pui leaves for Thailand for 2 weeks.

12-06-2012 Get a text message and email that she received an RFE

12-12-2012 RFE for original birth certificate. I swear we sent it along with a certificate translation of it.

12-20-2012 Pui returns from Thailand.

12-21-2012 We send the RFE back for with original birth certificate along with a new certificate of translation(I had to wait for her to return for her to sign)

12-26-2012 text and email they have received the RFE.

12-29-2012 Appointment for biometrics is 01-23-2012

01-13-2012 AP is approved.

01-23-2012 Biometrics appointment. Later during the evening the text and email saying the EAD is approved.

01-31-2012 EAD/AP combo card arrives.

05-22-2012 Email and text card is in production!

There is no USEmbassy in Miami (or anywhere else in the CONUS) in which to apply for a tourist visa.

What other ports of call does the ship have, outside the USA? I ask, just in case she gets close to a US Consulate or Embassy where the ship docks.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

The real issue is understanding what is required. She can not get a visa To the USA while she is IN the USA. She also cant use the work visa she has to stay in the USA.

She will have to apply at an American embassy which are all outside the USA. She will probably have to return to Thailand to even attempt this.

These tourist visas are difficult to obtain for anyone. This girl has demonstrated the ability to leave Thailand and work but she can also prove she came back. That may help her. She will have to understand the " strongest ties " rule to have a chance of getting a tourist visa. Is there is a petition for a K 1 she can forget any chance of a tourist visa.
