now i have most aos forms completed however since I not get my 1099's for another 6-8 weeks I can not file my taxes till then should I just use my i-130 sveta submited for visa for the i-864 forms other wise will make delay in aos filing

the tax year data officially isn't available or countable until tax season is over in April, so don't sweat that, to get tax data for 2012.

you can transfer data used on the I-134 to the I-864 - most people do that, as it's the easiest thing to do.

There's a section in the I-864 for 'current annual income' but yer at a cusp in the calendar - you need to decide whether to use 2012 data or 2013 data. It's probably safer to use projected annual income for 2013, but actual data from 2012 will work if you file this week.

for prior years, you must show tax data - you can show projected tax data for 2012 if you are using 2013 as your current year, just give a letter describing what you've done with this I-864 or you might get an RFE.

Since she's adjusting from a K-1, there's a 80 percent chance she's not going to have an interview. IF there was to be an interview, she has a chance months later, to submit actual 2012 tax year data on interview day.

So, whilst you're still deciding to wait or file immediately, think of this, aye? get yer wife a SSN now in her VISA name (not in marriage certificate name) as it saves her time and frustration for joining in with USA Society , simple things like the two of you filing a tax return together, her being added to yer bank accounts and medical insurance, etc.

darnell since I am self employed my income is not set. some months i earn 2k other months can be 6k hard to figure so guess will just use the data sveta gave to embassy

also would you give me a check list of docs I should send for aos I really not want pay a lawyer again for them make mistakes as you read my posts lawyer not do me right. if i understand correct since sveta not have police record i not need send anything from police for her correct? and tks
