I was reading the form and uscis about filing for ap. ( yes gary I did read lol ) if i understand correct a k-1 can not file for ap unless something very important came up and the visa holder had to return back home? but for a basic visit and for us would be have wedding party for sveta family does not apply. also from what I read gc is taking about 4-5 months so my question is would filing for ap help us or not? also would there be a fee savings since we are planning make visit mid-fall season if i think right sveta should have gc by then

Looks like you were married a few days ago. Congratulations !. Now you want to file for Sveta's AOS. You file for AP at the same time, there is no additional cost. You should get it in a month or two. She will need this to travel and she can travel as soon a she receives it. You will receive an appointment letter in the mail to do biometrics and then after that a date for the interview. If you plan to go back for only a few weeks ok. If longer than have some one watch your mail as you do not want to miss the biometrics appointment.

For emergency AP (the one you get via an info[pass appointment) you need a good reason. For normal AP, visiting family is enough.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

exactly what penguin said - file for AP - doesn't cost any extra and you will get it with the EAD - a combo card. On the application it will ask for dates you intend to travel. You do not need specific dates. We gave a general time frame ( in the spring to visit family). While some are getting their green cards in 4-5 months, others are still taking a lot longer :( It really isn't that much extra paper work for the AP and that way you will have it in case your green card takes longer. We are already at 4 months and EAD/AP was approved in Nov. but we haven't heard anything else - haven't gotten an interview letter yet so I have a feeling we could be in for longer than 4-5 months.

It is free to file with AOS so file and hope for quick approval. When we filed we only got AP about a week before approval of green card but its worth a shot, and Sveta will be able to travel with it no problem.

You can file for an AP when you send in the I-485. You do not need a special reason for it. If filed WITH the I-485 there is no fee for the AP. Also file the I-765 form for the EAD at the same time. You should receive the AP/EAD in about 3 months.

IF any type of emergency comes up AFTER you file the I-485 and she needs to leave, you can get an emergency AP by making an infopass appointment. Bring your I-797 receipt for the I-485. Until she has an AP or the green card DO NOT LEAVE the USA for any reason without going to USCIS first.

Correct, and the reason for an "emergency" AP does not need to be "an emergency" but you do need a valid reason. We got one for our son to return to college.

4-5 month for GC??? You will be lucky. I filed in April of 2012, guess what I am still waiting. We did apply for AP and got it without any problems, already travelled with that twice.

I want to fully understand this today I called dos and asked about sveta's Alien Registration Number they tell me none is given till aos is completed and advice me call uscis for questions so i did and as before no help there. was info from dos correct? till aos is sent off there is no Alien Registration Number? or what should i use on all forms asking for this number?

DOS was incorrect. Her A# would have been on her NOA2 - the approval letter for the I-129f. It should also have been on her K1 visa and her I-94, but since sometimes these are incorrect, use the one on her NOA2 since this was issued by USCIS.

I say file for AP and EAD with the I-485 submittal. It's free, fees are waived when filed with the I-485.

Who knows? She might want to get home for Easter , visit with her parents.

There's a registration # printed on her visa. Use that one.

now i have most aos forms completed however since I not get my 1099's for another 6-8 weeks I can not file my taxes till then should I just use my i-130 sveta submited for visa for the i-864 forms other wise will make delay in aos filing

Ron, I would think you would be able to use the same ones. I thought the AOS packet was more tedious than the K1. A couple of people have posted good check lists for when your packet is complete. Make sure you include 2 photos for each application (AOS, AP, EAD) so 6 total and a copy of marriage certificate for each app as well. don't know why but i almost missed including the marriage certificate for AP and EAD - had it with the AOS.
