I am a conditional green card holder and i am going to file divorce.

When i file for ROC by myself do i need a new sponsor? Since I am not with my husband anymore and he and his friend were my sponsor and my co-sponsor when we filed for the conditional green card.

Would it help if I start working and If file my taxes when I apply for the Permanent GC by myself?

I have another question how do i get my husband tax transcripts where he claimed me as a dependent in 2011? I need it for evidence for marriage in good faith. Do i need a lawyer to get that document? I know my husband could get it but We are separated and not talking at all so he won't do that favor to me.

Use your social security number to obtain transcripts from IRS. Use their web site or go to your local IRS office for help. Transcripts are free by fax, mail or in person. You do not need a lawyer to get them.

Consider getting some free legal advise about divorce from groups in your area. You may find that youyr husband ends up paying for your lawyer for example. Find out what your legal rights are under the laws.

You do not need a new sponsor, the I-864 your husband filled in still holds even when you divorce.

It doesn't really matter for ROC whether you are working.

Since you are listed as dependant, you may be able to get a copy by calling the IRS and ask for a copy of the tax return transcript, not sure.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

The IRS have on file our old address (where he lives now)..So on the IRS website says that if I moved from that address I can only fax or request by mail the tax transcript. I did that a month ago and I never got anything.. After trying to calling them..I got to talk to someone and she said that Since that how i am going to request for tax transcripts if i never filed taxes.. which is true. We didn't file our taxes together.. He filed his taxes and he claimed as a dependent.. So he is the only one who can request those taxes.. after talking with the girl for a while she said that she will send them to me!! but I still didn't get anything.

Did you sign the tax return he filed? Did you file taxes at all? What state do you live in?

This may be too difficult for you to do alone. Seek help. There are people or legal aid groups that can help you. Call a local family lawyer to ask if they can help you with all of this and if so would your husband have to pay if you dont have the money. He has a huge responcibility towards you until you are legally divorced. Find out what the law allows you to do.

You would never have been claimed as a dependent. A spouse is never a dependent. if you filed joint returns then you can get a copy by ordering online, by phone, or in person using your SSN (and address on record when you filed).

The I-864 from AOS is still in effect so you don't need a sponsor.

Did you sign the tax return he filed? Did you file taxes at all? What state do you live in?

This may be too difficult for you to do alone. Seek help. There are people or legal aid groups that can help you. Call a local family lawyer to ask if they can help you with all of this and if so would your husband have to pay if you dont have the money. He has a huge responcibility towards you until you are legally divorced. Find out what the law allows you to do.

He has no responsibility towards her to pay her immigration fees or pay for anything actually unless the court orders it.

You are going to have to go to a walk in tax center and ask for the print out in person. All you need is an ID to get the print out. When you call up and ask for the transcript by mail or fax, by default the computer will only send it to the address on file. According to your post- the address on file is the 'old address' where he lives now and you do not. So- you ordered them a month ago- So they did sent them to you, but they were sent there (the old address)

So use google or the IRS.gov site to find your local walk in taxpayer center and simply go down there and obtain the printout you need.

ya, easiest is to walk into an IRS office, ask for tax transcripts.
