On US tourist visa, got married but not in US

Hi,

My girlfriend applied for a US tourist Visa and was granted 10 years multiple entry. I am a LPR for 4 years. Prior to her applying for a visa, we have made plans and was set to get married in our home country.

We went on and got married.

Now the question is, can she still travel to the US using the visitor visa prior to our marriage?

She hasnt changed her name and marital status on the passports, etc.

Can she travel back and forth while i wait for my citizenship and then apply a petition for her once i am a US citizen?

Whats the best way to do so we can be together. Thanks in advance!

She will have to tell CBP that she is now married to you. Not sure if there will be an issue with the name. Perhaps someone else can chime in. Maybe bring your marriage certificate as proof. Not sure if they will allow her in now that you are married as CBP would view her as having immigrant intent

I believe she is supposed to advise them of the change in her circumstances (I posted a link to that effect a while back but that was the VWP) as her eligibility has changed... but I don't think many people actually do that.

At the very least she needs to tell them "I'm visiting my husband" at the border if asked for the reason for her visit or who she's staying with. They might deny her entry if she said that though. So be aware.

You need to bring strong proof of intent to return. If you have good proof of that then it should not be a problem, especially if she has traveled and returned on the tourist visa several times before. My husband has done it twice and been fine, though he was sent to secondary inspection. (Also I dont live in the US).
