Timeline

When you received your NOA2, was there an error on it about the spouse being in the US and adjusting status? Unfortunately, mistakes happen and I've seen those going for an IR-1/CR-1 visa and then get a NOA2 saying they were approved, but had a note written about them adjusting status from within the US (even though they clearly weren't).

Yes actually when I read again the letter it does say that my wife will be waiting a decision on her adjustment of status.

That should have already alerted me with a red flag but I did not pay attention thinking I was receiving a standard I-130 NOA2.

I just don't know if all this is just going to complicate things dramatically and we can't sort it out for months!

I have no idea why they went to AOS...

Bad luck I guess... :-(

I'm not sure of USCIS's hours, but call up immediately and explain the error on your notice of approval. Ask them what to do (if anything).

I just did. They said they put a service request to have my file transfered to NVC... They said I should receive a letter in 10-14 days.

But I am really not hopeful as I have ZERO trust in what they do :-(((

I suggest calling them (USCIS) once or twice a week, starting next week, to see if they indeed transferred the case to NVC. Once you've heard from at least three different operators that your case was indeed sent, then start calling up NVC to see if your case has arrived.

If you want, you may want to consider requesting an expedite, due to USCIS error. That because of them, it's cost you X amount of time. I've seen this work in the past ;)

You need to have a case number, so you'll need to at least wait for that. Once you have it, then call up NVC and ask what to do for an expedite request. They'll give you the instructions on exactly what to do.

We Just learned from calling the NVC that our package had been approved and was being sent on to schedule a interview date. I was hoping that someone could tell us how long it took to schedule a interview we are being sent to the Juarez consulate, also if any one knows how far the scheduled interviews are out that would be great.

I´m about to send all documents for my wife and me (we live abroad in Spain).

I have just one question: Besides all the documents that NVC asks for AOS and IV packages , do I have to attach photocopies for all of those documents? For what I´ve been reading in the forum, I´m a little bit confused in this detail.

The only photocopies you need to include are of the beneficiary's birth and marriage certificates (and divorce, military records, if applicable) in the IV package. The purpose of the photocopies is so you can get the originals/certified copies back at the time of the interview.

Just for the context, my wife (the USC) and me are living in Spain, so we´re filling abroad.

Our headaches comes from parts 5 and 6 of the I-864 formulary as a main sponsor (we have a co-sponsor), we are not sure how to fill this parts.

- Part 5. The household size. Should she count the people in our spanish domicile, or just count me because is refered to US territory ? Any other way?

- Part 6. Sponsor´s income. She doesn´t have any income for the US, just a not very well paid job as a english teacher here at Spain that would quit once we leave to the US. How should we answer question 22? Should my wife count her spanish income for questiond 23 and later? Or just answer with 0,00 $ since she is not working in the US territory or a US company?

Also in the DS-230 form. In question 29, I listed our son: he is an US citzen. In the question 31a (Person named on question 14 and 29 who will accompany you to the United States now), shall I list him there also, since he will be travelling with us, or type NONE since he is not an inmigrant?

Thank you so so much for your help, we really appreciate your time helping us, specially when we´re about to send the packages!

For the AOS, you should really start by reading the instructions as they're very helpful : http://travel.state.gov/visa/immigrants/info/info_3197.html.

The sponsor's income has to be included anyway.

If you intend to use the immigrant's revenue, then you can only use it if it will continue in the US.

You household includes: spouse, dependents, people sponsored now or in the past, wherever they live.

Not sure about the ds-230 though...
