Hi

wondering if anyone can help me, I have a US fiancee and we are in the process of applying for a fiancee visa for me and my son on to go the states to marry and eventually live there, I understand I need a notorized document from my x husband allowing me to take my son (has anyone done this and if so how should it read) and also when I get my interview in London do I take my son with me and does he require a medical, vaccinations etc?

any help and guidance would be appreciated

If you have sole custody you don't need a letter from your ex, it's enough with a document stating you have custody. Yes your son needs the medical and he might need some vaccinations, the vaccinations depends on what he got so far and what is age appropriate. ( my son needed one shot). And yes he will attend the interview with you.

What is the child's age? His immunization requirements will be determined by age.

K2 children under age 14 do not have to attend the interview according to the embassy website. Second sentence here http://london.usembassy.gov/faq-imm-proc.html#iv057

Does my child need to attend the immigrant visa interview?

All applicants registered for immigration as the spouse, parent, child under the age of 21 of a U.S. citizen are required to attend the Embassy in person for a formal visa interview with a U.S. consular officer. Persons under the age of fourteen who are deriving status from an immigrant, fiancé(e) or Kii petition filed on behalf of a parent or are applying for a derivative V visa and are applying for the visa at the same time as the parent need not attend the interview.

Who is required to attend?

All applicants registered for immigration in the immediate relative category, including children, are required to attend the Embassy in person for a formal visa interview with a U.S. consular officer. Persons under the age of fourteen who are deriving status from an immigrant visa or a K visa petition filed on behalf of a parent and are applying for the visa at the same time as the parent need not attend the interview. They must, however, attend the medical examination.   

The letter: can't think of anybody recent that's done one and might answer you. I would give basic info.like his full name and address, that he is the father of [child's full name] who was born [date] in [place as stated on birth certificate]. Then a sentence stating that he gives full permission for his son to move to the United States with his mother, [your full name]. The solicitor could write something stating that he witnessed the document signature. Notaries aren't so common in the UK, like they are in the US, so that's why solicitors are usually used to add a bit of legality. The whole thing is to make sure this isn't an international kidnapping. And if you have sole custody, then a court order granting that would do also.

thank you so much for this information, he is 6 years old? Our I-129f forms will be sent away in January when my fiancee returns to the US from his work rotation, in the meantime should I go to the doctors here and make sure my son and I have all immunisatons that will be required?

also thanks for the information re the letter. I have been reading loads of threads over the past few days and it just seems such a minefield and I really appreciate the help you have given me with my questions

You will need these shots for AOS, not the visa, but it will be so much easier to clear that at the UK medical and be done with it rather having to pay a civil surgeon in the US to clear you if you wait. If you get your shots done way early, then you will need to complete the series...like MMR is two doses to satisfy the US requirements. That's because, say you got one next month, then had your medical exam months later. You wouldn't be cleared unless you had both doses. But if you got one dose less than 4 weeks before your medical, you would be given a waiver by USCIS because it would not be medically appropriate to have dose two sooner than 4 weeks after dose #1. Starting early like you are, just get the two doses and cover it all thoroughly. Varicella isn't generally available in the UK. Having chickenpox excuses that shot. They take your word for that. Everything else needs documentation.

Look at the top of this UK forum for the pinned thread for K1s after the petition is approved. Once you get the petition off in the mail, start reading that thread to prepare for the London part. It's too much to take in right now. One step at a time. Get the I-129F Petition squared away before you worry about the rest of it. You will have months to learn and prepare while you wait on petition approval (NOA2),

your help has been great thank you. do you know if it is ok for me to travel to the US to see my fiancee when we have sent the I-129f application. We will be posting this in January and I plan to go over for a week in February then go back again in March for 2 weeks taking my son with me.

You can travel while the petition is in progress, however, you need to bring strong ties that you plan to return. A return ticket, a lease, a letter from your job...all good things to have. You should check out the "Yes, You Can Visit!" thread in the K-1 forum for others' experiences.

Your second trip with your son may draw additional scrutiny, especially since it's so soon after your February visit. The best you can do is provide strong ties (perhaps add in a letter from your son's school stating he's on holiday break from [date] to [date]), be honest, and hope for the best when going through customs. Good luck!

Almost ready to send our appication away, we are hoping this is posted next Monday from Houston, I can't tell you how excited we are, just wanted to share with everyone who has helped me so far with my questions, I think I will need a lot more help with my questions as the process proceeds and a lot of hand holding, just wanted to say thank you so far
