Hi all,

I want to bring my mother over. I am a US citizen and my mother is in the Bahamas. I know I need to file an I130 and I485 for her. Once she is approved with the I130 does she need to immigrate to the US or can she stay until she is granted a green card?

Thanks

why to use I-485? Don't you want to get her a visa?

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

no need for the i485, she will go through consular processing and have an interview at the US and she will be granted a visa to come to the US. she will get her GC once she is in the US. usually the process will take from 8 months to a year.

for now, just the i130, payment and documents required

Thanks for the reply. I think she has a visitor's visa right now. So I will just need to file the I130 for now. I'm just want to figure out when to tell my mom she's going to have to move so she can get all of her affairs together.

My question is once she gets the i130 approval does she need to come to the US. And does the I130 process take 8months to a year or the whole process of getting the GC?

why not come over on an immigrant visa, instead of the route you are thinking about?

less time to green card issuance, and less money for you to spend, when chasing an immigrant visa.

I thought she couldn't come over on her visitor's visa if she intends to file for a greencard?

once the I 130 is approved that does not give her a visa, it only gives her an approved petition. After the petition is approved it goes through the NVC and then off to the consulate or embassy for her interview. it is at the interview that she either will or won't be granted a visa. If it is approved and issued she can then immigrate, and has up to 6 months after this day to do so.

a tourist visa is not an immigrant visa.
