upgrade I-130 from LPR to USC

I am a LPR and I filled I-130 for my wife almost 5 months from now in California service center, when I went through CSC I found it takes almost 14 months for I-130 to be approved, now I m gonna get my citizenship on Jan 2013, so If I upgrade my LPR to USC, do I still be considered for 14 months for my I-130 to be approved or they gonna switch me to 5 months to be approved and they gonna consider the date when I filled I-130?

N.B: When I went through How to calculate your cycle time, I found that California Service Center doesn't treat I-130 for Citizenship filling for Spouce, only 2 offices do that TSC and VSC.

Expect your petition to be approved within a couple weeks of sending in a proper upgrade request. Once you're a citizen, the 5 month standard applies but it's no guarantee. What usually happens with an upgrade sent in after this long is they just go ahead and adjudicate the petition, when they pull the file to put it in the correct queue.

Expect your petition to be approved within a couple weeks of sending in a proper upgrade request. Once you're a citizen, the 5 month standard applies but it's no guarantee. What usually happens with an upgrade sent in after this long is they just go ahead and adjudicate the petition, when they pull the file to put it in the correct queue.

So I don't have to worry about my case because I thought it will take almost 14 months, but now I am happy that will take only couple of weeks after my upgrade.

So I petitioned for my husband in June and I was a LPR, in September i became a USC and i did the proper update, today is December 31 and my case is still at initial review, btw my case is at the CSC office....hope that helps.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

We passed the same path ...we have upgraded our petition from LPR to USC in september.....they will consider as a USC'spouse after update....

Our case status showed initial review for so many days.... but after priority date, we contacted congressman's office.They enquired about our case and we got approved our i130 with in two weeks after enquiry.

US consulate :Bombay.
29th January 2012:marriage
9th April 2012: i130 sent.
17th April 2012: NOA1 received...
13th December 2012:NOA2 received......
08th January 2013: Case number assigned by NVC
08th January 2013: paid AOS and IV bills.
28th January 2013: Sent AOS and IV packages to NVC..
20th February 2013: NVC sent checklist about our PCC ....
25th February 2013: We responded to checklist.
26th February 2013:Case completed....
4rth April 2013: Interview date...
Interview result: Approved

06th June 2013 : Reached USA

29th june 2013: Received conditional greencard...

14th March 2015: I-751 package sent to VSC.

18th March 2015: USPS delivered my package.

22 nd September: Approved for Permanent Residence Card.

25th July: NOA1 for N-400.
