Hello,vj's..happy New Year. I would rather called ex "pindejo" caused he was really idiot,stupid,engot.etc. Sorry for the terms..I am already annulled on ground of psychological incapacity. And in documents indicated the custody of my minor child,who is 6 yrs old, shall remains with the custody and care of me,as mom. I am thinking of asking ex for his permission to let kid to go with me. The problem is this..since my atty. knew ex didnt use his real first name in his identification cards and other documents,( which is another issue ..falsification of public docs. and needs lot of money to pay) How can he show/prove he is really the biological father of my kid because he uses differ name than one indicated in kid's birth certificate? Next question,during interview, is notarized consent letter of biological father enough to present? Your responds are really be needed and appreciated specially those who have same situations..please,kindly help me. thank you and happy new year.

You do not need anything from your EX "pindejo" ..... NOTHING, NA-DA, ZIP! In essence complete the process as if he doesn't exist as nothing is required or requested from him.

Now I would suggest bringing a copy of your anullment to SLEC during the medical and expect to be required to have an psychological exam.

Psych evaluation = Php1000. (This one for sure.)

Psych test = Php3000. (Doubt if you'll have to take this one.)

I thought that the custodial parent had to get a signed letter from the other biological parent to legally leave the country.

He can always prove he's the father with a DNA test.

Your ex is the one who claimed psychological incapacitation? If so, it's likely you will not have to undergo a psych evaluation or a psych test.
