Timeline

I will be mailing out my I-751 at the end of this month. But I have a couple of questions about I-751.

1. We sold our house back to the end of this September. We filed both I-865 and AR-11. We also got a receipt for filing I-865 but nothing for AR-11 except return receipt from USPS. My question is that do we need to include a copy of filed I-865 and AR-11, I-865 receipt and return receipt in our I-751 petition?

2. We will include a deed of house showing both of our names in the petition of I-751 even though the house is not ours anymore. Because we have been residing there since we got married in 2004. But for the new residence, I am the only one who is on lease. (I moved in the new apartment first due to new job before we sold the house). We have a couple of new bills for the new address, but our names didn't show on bills together. Instead, my husband's name is on the cable bills with the new address and my name is on the electricity bills with the new address. Should I include these in the application of I-751 too?

3. We will send in the fee with personal check. But our personal check was requested quite long ago, so the address on the check is still our old house address. Do I need to put our new address below on the check or I can just use the check w/o writing down the new address (it is still the same bank account)?

12/29/06 original biometrics appointment (didn't make it due to vacation)

1/3/07 biometrics appointment done in cincinnati ASC (only right index finger and photo were taken)

9/14/07 Received an email from USCIS stating that card is in production.

Hi:

First of all, guys, GOOD LUCK!

Second, when I filed for my I-751 I included a cover sheet with my application. It is a bullet point list with ALL the documents that were contained in the package, in order. This way, whoever looks over the file, knows what to expect and what to look for in the package. In that list, when you list, for ex your lease, you can put in parenthesis the reason why the lease is only on one name, i.e. "the lease is only on my wife's name because the apartment was obtained through her job"). You'll find some examples on this forum, I believe.

1.My opinion is to include a copy of the receipt and a copy of the USPS receipt stampled together.

2.Yes, include anything you have with both your names together or with your names separate, but same address.

3.You can cross the address on the check and leave it like that. Important is that the check is in both your names.

1: There's no need to include the change of address reports.

2: Yes. Household bills that are in only one name or the other are still of value. Many utilities won't put two names on an account, so this is a good substitute. The old deed is a good piece of evidence too.

I'd not recommend putting any important statements in the cover letter--it is likely to be discarded unread. If something is important, put it in an addendum and make a note somewhere on the form referencing it.

3: That's up to you. I would probably draw a line through the old addy and write in the new.

It's my opinion that it does not matter if one or both names are on the checks. I had a couple of old books of checks with just my name on them--wasn't going to order more just to have both names printed. We only write about 2 checks per month, so we don't go thru them very quickly. I know we used a check with my name only for I-751 (approved) because we didn't get the new checks until after the N-400 application.

Thank you very much. I think what I will do is to include the copy of address change NOA and return receipt from USPS in my I-751 application. And following that, I will attach the bills with new address. In that way, it will be self-explanatory about why the new bills and other supporting documents have the different address than previous ones and it will show the continuing relationship after moving. For the personal check, I will cross out the old address and put the new address in the check. Thanks again.

September 12 -Received my passport with the visa and yellow packet
November 24th -POE.......Guam,USA
December 12, 2005-Green Card arrived in the mail
September 11, 2007 -Filed I-751 on conditions
September 17 -VSC Receives my I-751 and issues NOA1
Oct 10 -Had biometrics taken in San Juan, Puerto Rico ASC
