have a small legal wedding and give us time to plan a big party for some time the following year.

So that means that you'll then be applying for the CR-1 visa and not a K-1. Correct?

I am living in Guatemala where my fiance currently is. I have about 6 months left here in Guatemala until I return home to the States as my service term as a Peace Corps volunteer will be finished. My fiance (a Guatemalan) and I want to get married in the States as soon as my service is over, in late July of 2013. We are barely turning in the I-129F initial Petition for Alien Finance Visa. We thought we were good for time but in looking at timelines here on this site we maybe 2 to 3 months behind already.

Help!

All tips on how to speed up this process?

We really want to have this wedding for the end of July 2013.

Realistically, is 6 months enough time to complete the fiance visa application process?

Thank you so much for any help/warnings/words of wisdom/etc. you can provide us.

sincerely,

EmmaJuly2013

I got married to my husband who is Dutch, in the US without any visa. He came over as a tourist (he could stay for 90 days without a visa) we got the marriage licence and got married with no problems. We moved to the Netherlands (are not planning to move back) so there wasn't any issue with that, and in the state of Oregon a visa wasn't needed for the marriage licence. So I guess you can still have the wedding when you want and possibly apply for a change of status - which is a different route, but I don't know exactly how that works and if he will have to leave. But it's worth a shot. You can always call the USCIS customer service, but they are a big pain the the #### to get through to. Good luck! It might be easier to try to do a change of status, but it costs $1000 instead of the $500,

No speeding here for this, don't make solid plans for anything.

No. Coming to the USA with a tourist visa or visa waiver with the intent of staying is visa fraud, do NOT do that or advocate that on this website, it is against our TOS to advocate illegal activity.

That being said, IF he can get a tourist visa (much more difficult from Guatemala than the visa waiver from Denmark) then yes, you could get married in the USA and then apply for a CR-1 visa, but he would need to leave after his tourist visa stay is up and do the medical and interview in his home country.

Entering with intend to adjust status is immigration fraud. entering with intent to marry (as in your case) is fine. So the last portion of your post is against the VJ terms of service, specifically, advising someone to commit fraud.

If you are already in the US you dont need a visa to get married. The purpose of the K-1 visa is to be able to enter the US with the intention to marry. You can marry no matter what visa you used to enter, however the problem comes when you adjust status.
