Hi All,

Have few questions regards to I765 being pending and applying for N400.

So, I applied my I-751 in Jan 2 2012 with VSC and received my extension letter on Jan 17, 2012.

Current processing date at VSC is March 5, 2012 although,I have not receive any letter asking for additional documents or anything else.

I called USCIS for an update on Dec 14, 2012 and I received an letter from USCIS on Dec 21, 2012 stating that my fill has been submitted to field office (Newark nj) and will receive interview in 60 days.

I got my greencard on 3/30/2010 so I though I am eligible to apply for N400 in Jan 2013. Although, when I called USCIS asking that if I can apply for N-400 while my I 765 is still pending, they said NO, I can't apply. I will have wait until my I 765 is clear. Does anyone had/have the same situation? If I apply for N-400, would that cause any issue? I read many blog stating that you can apply for N-400 if I-765 is still pending however, I was still not sure because USCIS said no when I called.

Any response will be appreciated.

They're idiots. Yes you can file while I-751 is pending and they will be forced to push though the processing of the I-751 before they can process the N-400.

that's why the 1800 number is called the "misinformation line".

you are elegible to apply for citizenship 90 days before the 3rd anniversary year of your green card if you are married, or 90 days before the 5th anniversary year. It's their fault to hold the approval of your green card. If I were you I would apply for the citizenship andnot wait for them. Send both sides of the green card copies, first extension and your stamp in the passport. Of course copies of those. Send everything you are required to send and sit and watch. They will do the work now.

Thanks Everyone for your respond.

Just to give you guys an update.....Our interview is scheduled for Jan 11, 2013 for I-765 (Removal of Condition) in Newark NJ. I also applied for N-400 back in early Jan 2013 and received biometric appointment letter within two weeks scheduled for Jan 31, 2013. Have not receive anything for N-400 interview yet.

For I 751 interview- What are some of the questions asked? Do I need to take all the documents that I send with my application? Is there anyway I 765 and N-400 interview can be combined? I am mean biometric are completed so I was just wondering if anyone had similar situation.
