hello, my name is Jane 18, im from the philippines. my boyfriend is leaving at the 20th of january as an immigrant in Chicago. it's hard that we will be far away from each other cause we have a 1 year old son. my question is, how long will it take for him to petition me and our child and what type of visa should we apply for? should we apply for a k1 visa? we are not yet married and please help me what kind of visa should we apply for? which would be easier k1 or spouse visa? im looking forward to be with him in the US with our child. thanks!

it depends on type of his visa. If he is moving to US as a legal employee under H1B visa then he can apply for H2 visa for you and your child, it may take a few months. If he is under a student visa (F1 visa) then he can apply for F2 visa for you and your child, it also takes a few months. The thing here is that once he get his green card it will take much longer for you to reunite!!! about 2,5 years of waiting time after he files his petition for you. So if he did not get his green card yet then it is better to include you into a Green Card application once he could apply for a permanent residence.

hi kabayan! i have same case as u are. I left the Phils last sept 2010 and my live in partner was left behind but as soon as i got my green card, after 4 months i returned to our country to marry him. then as soon as i am back here in USA, i filed the petition for him. as of now, the waiting period is only 2.4 yrs. from the date you have filed it until the interview. so if he can come back to our country as soon as possible like what i did, of course the earlier the better.

Good luck kabayan! God bless and Merry Christmas!

FINALLY! hehe! kasama mo na sila jan kabayan? grabe nalulungkot na aq pa alis na sya january! sana magkawork agad at makaipon para makauwi sya at magpakasal na kami! :) merry merry christmas kabayan!

How come he is leaving you and the child?

Seems a pertinent question.

Because he was petitioned under F2A which requires him to be single upon entry to the US. When he activates his visa, he can go back and get married and file for his wife and child. 2.5 yrs wait, but it's the fastest so far.

I would suggest you read the VJ guides that apply to both of you and directly on the USCIS site for information, then after having a base of information come back and you will be much more informed. That way both of you can obtain more knowledge on the subject matter directly and it will help you in the long run.

In Arizona its hot hot hot.

Depending on the type of visa he is going to enter with, it is possible that if you were married you could join him as a dependent. I'm not very familiar with those visa regulations, but perhaps you could poke around other forums and check up on it on the US immigration pages? I know that dependents of students and employees can often enter on certain visas (F-2 for F-1 visas, is the one I've personally heard of).

You have given some many mis-fact information in this post, that it would be if your posts were deleted, so that your incorrect statements would not mis-guide anyone else who would be in the same postion.

Apologies but what gross misinformation? I suggested looking into dependent visas if his visa was applicable which it may be? Someone above has mentioned the same thing with more specifics.

The guides here would help answer this. It'll take about 6-8 months (average right now) to get the petition approved, but then it will take another couple of months to get the visa approved depending on your embassy.

Also, listen to what Penguin (above) says. My estimate is based on the assumption that he is a USC, but if he's not then ignore me.

Let's start with this post:

1. The Poster stated that her BF was coming as a LPR, therefore he can not file for a K1 visa.

She wasn't asking about a work or student visa, the oster stated in her 1st post that he was arriving as a LPR. Again, mis leading the poster away from her orginal question.

A student or a worker would be a non-immigrant visa.

Well I didn't clearly understand that he was coming like that, hence my condition at the end that it was only applicable if he was a USC - which was answered that he was not. This question was asked in the K-1 visa forum, hence my applicable reply.

A student or a worker would be a non-immigrant visa.

And how many times on this forum has the term "immigrant" been used incorrectly? Again, my answer was clearly situational and disclaimed as such.
