Hello! I am filing for K-1visa. my fiance is in Vienna and we have been in a relationship for more than 9 years. When I was still in the Philippines we see each other yearly. But the most recent one is on June 2010 which is more than 2 yeas from now. I would like to know if explaining the reason for not seeing each other within 2 years is enough to fulfill the requirement. My fiance cant come here since he is not a citizen in Vienna and I am new at work and cant get a vacation.

No. The two main requirements of the I-129F petition are that you are both free to marry and you have seen each other in person within the 2 years prior to filing. You need to visit face-to-face again before filing. The visit can take place anywhere the two of you are able to travel to.

No. The two main requirements of the I-129F petition are that you are both free to marry and you have seen each other in person within the 2 years prior to filing. You need to visit face-to-face again before filing. The visit can take place anywhere the two of you are able to travel to.

You would have to prove that meeting your fiance in person would cause you extreme hardship. Not being able to get vacation time will not work. Unfortunately, they will not count all the time you spent together in the past to waive this requirement.

Try to cut a deal with your new boss to give you some time to go see her. Even if it's for a few days, that would be enough to file the petition.

No can do. Do not mail the petition, save your money and then you two MUST meet in person, document that meeting and use it in the petition and then mail it.

The rules are the rules and you do not qualify for an exemption, which is very rare.

Nope. You have several options:

- Ask for (unpaid) leave from work

- resign

- get the fiance to apply for a tourist visa

- Meet in a third country close to the USA so you can fly there for the weekend and the fiance can get an easy visa or doesn;t need a visa.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
