Us citizen daughter trying to apply for change of status for dad . His visa expired few years a go and my question is : can she apply for adjustment of status if he entered legally but remained in the USA after visa expired ? And how can she make him legal he is also 70 years old if it would make a difference . Please help! Thanks!

Yes, you can, since he entered legally, it is possible to adjust status. You must file a forms: I-130, I-485, I-765 (if he wishes to work). His age has no bearing on the process, however, yours do. you must be at least 21 to file a petition.

Yes, AOS is possible. His age MAY play a role- USCIS will be concerned that the beneficiary cannot/ will not work and is not elligible for medicare and medicaid for several years, so on top of the usual 125% poverty line, they may require you to show proof of health insurance.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
