IR2 UK Application

Hi VJRs

I came to the US a few months ago and we filed for my daughters I130 at the end of September. I believe that the I130 will be a IR2 application? Does that application take the same amount of time as a normal I130. She is 19 years old and our marriage took place before her 16th birthday. I guess i am just missing her and wanting it to go through quick...... first time we have ever been apart.

I have most of the paperwork done waiting for the Noa2......

thanks for your help x x x

- Did you come to the USA less than a year ago? If so, did you file "follow to join" or a completely new petition?

- If you filed a new petition, did your husband (the USC stepdad) file, or did you (LPR mom)?

*** Moving from CR-1 spousal visa to Bringing Family of USC as stepdad filed a separate petition *****

Yes, it takes about the same amount of time as a spousal petition, so just under a year. She can visit with the via waiver program in the meantime.

HI Guys

i am getting a little confused about the FTJ, reading alot about the K2 FTJ not much on CR1. I came to the US 9 months ago on CR1. My visa was approved on 2nd Feb this year. Can i file for a follow to join for my 19 year old daughter. Our marriage took place before her 16th birthday. If we file who files the LPR or US husband? I need to get it all done ASAP so she can come.

So i would start her application as packet 3? the i184?. I filed a i130 for her about 8 weeks ago would i need to cancel that if i file for FTJ.

Any information would really help me thank you in advance ......

Someone will correct me if I am wrong, but there is no derivative visa for the Cr-1, you cannot follow to join, a separate petition needs to be filed and another visa to be applied for.

Good luck

No. A CR-1 does not allow for derivative beneficiaries.

A K-2 I only possible within 1 year of a K-1. You did not enter in a K-1, so your daughter cannot file to do a follow to join as a K-2.

Since you married your USC husband before your daughter's 18th birthday, he can petition for her with a I-130. At age 19, she would be an Immediate Relative. It would take 6-12 months for her to get a visa. (If you file, it will take 3-8 years, so make sure your husband file the I-130 and not you.)
