Timeline

Can I actually write to the consulate/embassy to ask them whether my fiancé's income situation will be acceptable? Basically, we don't have a cosponsor but over the last six months after being laid off my fiance has earned over $10,000 through freelance work. If we can annualise that, it should just put us over the requirement. I am confused about this because I have had people on VJ tell me that new jobs aren't necessarily recognised for income purposes due to not being clearly stable/on-going. So I didn't think we would be able to rely on irregular freelance work over only six months. But I've noticed other people have posted saying that they did 'annualise' income that they did not have a full year's worth of.

I'm just wondering if it's possible to actually ask the consulate things like this, in advance of sending my packet 3 in. Does anyone know?

Writing the embassy will only give you a generic answer. They will not be replying specifically to your income. His income doesn't meet the guidelines. For two people you have to be at or above $18591.

Yes not steady work can be rejected. Your fiance' (The USC) has to convince the US Government you will not become a public charge when you immigrate. Someone who hasn't had stable employment that raises red flags.

My fiance started his job on the 30th of October 2012, we provided a letter from his Employer stating his position and salary and that it was a full time job. I had 3 years of tax returns only, no paystubs, transcripts or W2's....at the interview they read the I-134 and the letter and that was it, they didn't ask me for anything else, briefly asked me what he did, didn't even ask me what he earned. Josh had worked for his current employer for 3 years, from 2008-2011, and his employer noted that in the letter and that they highly valued him as an employee and friend and I think that helped. We couldn't find a co sponsor either, so it was pretty scary

I think if you can provide evidence of current income and evidence of what he has been paid up until this point and any tax returns you can get hold of (if they ask for them) you should be right....you just never know. I may have been lucky on the day, it all comes down to who is looking at your case. Just arm yourself with as much evidence as you can that even though he doesn't have steady income now, he always has in the past and as much evidence you can that the work he is doing now is going to continue.....stability and meeting the USCIS income guidelines is what they are looking!

JEC I really appreciate your support and sweet thoughts. :) And thanks for the tip about the employer letter - I'll suggest to L to have his employers say something along those lines too.
