IR-1/CR1 question

it's been quite a while since i posted in VJ... I hope that you're doing fine

Well, I have some news (at the CR-1 side) and I need your help/suggestions as usual :yes:

Hello everybody,

I took the K-3 visa interview on 19th october in Casablanca (Morocco). I was given the 221(g) paper, and was told that the A/P will take about 2 months... if not longer as some VJ told me!! :crying:

In the other hand, my husband, in USA and he is the agent, is following the NVC Chart for I-130 (IR-1/CR-1). As you can see from our timeline bellow, he sent back the I-864 and it was received. He received today the IV Bill. He'll send back the payment tomorrow.

I have a couple of questions, and we'll appreciate your help

- Could you plz tell me what will be the next step in the NVC follow chart?!

- option #1 : What will happen IF the CR-1 case is complete BEFORE i get an answer from the consulate concerning my 221(g) for k3-??

OR

- Option #2 : What will happen in the opposite case, i.e if the A/P is complete and the consulate calls me to bring my passport before the IR-1/CR-1 is complete?!!

One more question : what is the "estimate time" to the IR-1/CR-1 interview when the agent pays the IV Bill ?

Thank you in advance for your help & your suggestions!!! we really need them at this specific time :)

9/30/09: got an email from USCIS. Production of the card has been ordered.

10/07/09: Got 10 years GC in mail

1. If CR-1 is approved first, you have the option to "abandon" the K-3 and stick with the CR-1. That is what we did. I prefered it that way coz CR-1 gave us better options.

2. You are on A/P and applied again?? (i'm a bit confused on that) .. anyway..if they tell you to bring in the passport.. then my guess is that you just stick with what they give you and drop all the other visas (if that is what is in your best interest)

3. I don't remember what an IV bill is..so I can't answer that one.. sorry .

From looking at her timeline, Najia and her husband had already applied for the CR-1 before applying for the K-3 (as is required.)

The IV she's referring to is the Immigrant Visa fee (used to $380 or something like that... but may have been increased since we went through it.)

Your CR-1 may indeed make it to the consulate before your AR is completed -- this is certainly possible and it's happened before. However, you would still face an AR with the CR-1. So you will still have to await the results, even with a CR-1.

If the AR completes BEFORE the consulate gets your CR-1 application, you will still be issued the K-3.

But if the CR-1 application reaches the consulate and you get an interview for that while you're still on AR, I believe you would be issued a CR-1 visa instead of the K-3 (of course, upon completion of the administrative review.) Someone correct me if I'm wrong here.

I am sure one of our members who has processed a CR-1 through Morocco recently can give you their timeframe on how long to interview.

I SO WISH IT WAS TRUE!!! No visa was issued, they told my husband that I have to find out what's going on with the K-3 visa and it's still going and going and going.... like in that TV commercial for Energizer Batteries!

They keep telling us that they're waiting for K-3 and it doesn't seem to be moving anywhere. Is there an 'option' to abandon the K-3? I'd love to know how. Thanks

One more thing. I want to go to Morocco too!!!! I wish I could!!!

yes you can abandon k-3 but you want to make sure the i130 was approved first. that is what our lawyer did and it worked out beautifully.
