Hi there,

I'm just trying to consider options for the future if my husband gets a K3. I've been looking at how long it takes to get the EAD for some people. My husband is worried more about our finances than I am, and was wondering if he could return to Canada after entering on the K3 and applying for the EAD.

I was wondering if (1) it is one of the requirements of the EAD that the petitioner be in the U.S. waiting for it to be processed, and (2) could he risk losing his K3 by doing this?

Perhaps I should ask this in K3 forum, but thought I would start here. I've read the guides and browsed the various threads but haven't seen an answer to these questions. I don't think he can lose his K3 by doing this, but would really like to get this confirmed.

1/25/07 - approved ...NOA2 via snail mail - 1/29/07

03/16/07 - chose not to return packet 3 to Montreal

Hi Riblet,

I entered on a K3, applied for the AOS and EAD and have been out of the U.S. twice since that time. I haven't wrapped up all my personal affairs as yet in the Bahamas, and figured it would be good to apply for the AOS and EAD to reduce the time I will spend sitting at home doing nothing once I relocate permanently. As the K3 visa is a multiple entry visa, your husband shouldn't have a problem. He will, however, as I did, have to come back to do his biometrics.
