we are doing the cr1, and are sending our i-130, as with the k1, we have to send us passport style photos.

my photos were sent to my wife, usc dated 8th Oct. so, they have to reach the uscis by 8th nov.

does anyone know if the '30 rule' is strict and we could get an rfe is it reeaches them on day 32 or so?

How are the photos dated? Is there some sort of notation on them?

I doubt very seriously they will know when the passport photo was taken unless you wrote the date on the back....when we sent in our passport photos, we just wrote our names on the back, no dates. There were no questions as to when they were taken.

Well, since the date was written on the back, they have an idea of when it was taken. If it gets to them past the 30 day mark they have a reason to send a RFE. That is the USCIS for you. Hopefully for you though, you will have an adjudicator who will just see that it took a little while for the package to reach them, that's all, and everything will be ok. Good Luck to you.

I think we all can learn something here. The only notational requirement for a picture is writing the applicant's or beneficiary's name on the back... No dating of the required.....

Unless there's a date on the passport photo, you won't be held in violation. However, some passport photos do have dates and it would clearly be a violation of the 30-day rule. How strictly USCIS enforces this is probably a mystery to most of us. But there is the rule! So, if the passport photo does not have a date printed, don't worry. But if it does have a date like my Fiancee's passport photos from Brazil, then I'd make certain the date on the photo and my application fell within the 30-day window!
