Hi everyone,

So it's gotten to the point where I just really need a lawyer or migration agent to help me figure this out. Our friend who was going to co-sponsor changed her mind, we really don't know who else to ask, and the financial situation between my fiance and I may allow us to get through but it all depends on too many maybe's... I have spent far too many hours trying to figure it all out and I just want somebody who can tell me how this works and how best to present our case. Can anybody recommend a good lawyer? Ideally someone who works with a lot of Australian cases seeing as every country seems to have such different requirements.

I'm sorry I don't know any immigration attorneys that could help but maybe if you post your situation we can help you understand it?

With the friend, tell her the I-134 isn't binding. It will at least get you to the US. BUT if she's not willing to sign the binding one, the I-864, when you file AOS, then you won't get a greencard. While there is no deadline to file AOS, you can't work or leave (and return) without a greencard.

The I-134 in Australia they basically just need to see an employer letter and a bank letter. They will also accept just a tax return (from other reports).

1. Is your fiance making more now but worried because his tax return doesn't say enough?

2. Is he not earning enough now but did on the last tax return?

3. Does he have any assets to show (a second car would count, the equity in a home (value of house minus mortgage), stocks/bonds etc)

4. Do you have any assets?

5. Are you working a job which will continue once in the US (say transferred to a US location or working remotely)?

If the friend can at least help you out to get to the US (by signing the I-134) then you could look after the home or whatever else while your husband gets another job, or finds another one that pays better so that he can process the I-864 himself (or at least give you more time to ask someone else).

Remember that a co-sponsor can be anyone, as long as they are a US LPR or USC.

Vanessa, thanks so much for all this. I don't mind going into it further but I would probably prefer not to put all my details on here. Would it be alright if I sent you a pm? Let me know if you'd rather not as I know you can't give everyone personal consultations here, lol. So I wouldn't be offended. I think I'm just probably at the point where I will have to hand it over to a professional - much as it feels awful to me after having spent countless hours and sleepless nights figuring all this out over the last 12 months, and having done nearly all the work myself anyway. It's just that there's so much at stake and I see these other people who have gotten snagged or outright denied when they made mistakes in their documentation or missed a deadline or something. I have put so much effort into this and really feel I would have been better off going to work for someone else and having the money to pay for it. lol! But yes, if you or others could shed some light on this for me I would really appreciate it. I am hoping to at least be able to learn enough to do the next stage for myself anyway, when we get to AOS/i-864. So if anyone here is interested in hearing/commenting on this stuff more, please let me know and I'll tell you more by pm.
