Can I include my Fiance's engagement ring as an asset of mine?

I gave it to her when I went to Russia and she has it in Russia with her.

She will bring it with her to the interview, and we also have an appraisal for it.

Also, to include my car as an asset, is there a specific way to get an appraisal? or can it be from any mechanic? I cannot find the Kelly Blue book value of my car since it is a 1971.

thanks.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Engagement ring: Unless it is a $20'000+ gigantic rock, I wouldn't. You can use jewellery but using every ring etc you have may make the CO wonder if you can truly afford to keep her (plus, most women wouldn't sell their engagement rings).

Car: if it is your only car you cannot use it. If you have another car then yes you can. Can you get an appraisal on business letterhead from whatever mechanic takes care of it?

If your income is sufficient, there is no need to list any assets (and therefore not the bother).

It is my only car. Where did you read that you cannot use your only car? I must have missed that.

The only car and primary residence falls under the undo hardship clause--assets cannot be used if converting them to cash causes an undo hardship on the sponsor. Besides assets are taken at 1/3 their fair market value for a spouse and 1/5 for everyone else. So unless this ring is quite expensive it is not worth paying to have it appraised.

So you need assets of $60,000 to cover no income if sponsoring a spouse.

If you NEED to use these things as assets to qualify you have bigger problems which should be addressed. If you make enough money you do not need to list ANY assets, just leave that info blank. If you need to use the car, you need to have it appraised by a qualified person, such as an antique vehicle dealer. They will need something to plausibly assign a value to it and you also need to show clear title or loan balance so the NET value can be calculated.

You then get "credit" for 1/3 of this toward any shortfall in income. For example if you need $19,000 in income and you have $16,000, then you need $9,000 in assets to make up the difference.

Also, assets do not have to be considered by the consulate in any case, so if you are actually trying to qualify on assets I would have a co-sponsor also.

I agree. There are no particular qualifiers for an appraiser, because there are no particular qualifiers for ANYTHING regarding the I-134. Now before you think that is "good news", I assure you, it is not. It means YOU need to convince somone that does not know you and knows nothing about cars and spends exactly 33 seconds reviewing your case (which is 26 seconds longer than they spent on mine) that this car is going to prevent your fiancee from becoming a public charge. See? Yeah, even sounds silly to read it, doesn't it? Now imagine trying to convince them of that if "Bob" at "Bob's Garage" says it is worth $30,000. IF on the other hand your appraisal was from a antique auto auctioneer, that may carry more weight. Or maybe they just toss out the whole thing and demand proof of income. They CAN.

But for all that it is still not quite as silly as "And if we don't have any food, my fiancee here will sell this here diamond ring I gave her...won't you, sweetheart?" Yeah...you got it now.

Are you saying you do not have a job and do not have a co-sponsor?

No, I have a job, with a salary of $33,000 per year and I have a letter from my employer, and copies of several paychecks.

Hopefully that will be enough. I just wanted to include everything possible, since I recently graduated from my masters degree, and I do not have a house, or any large savings yet.

My only concern was my bank account balance.

You just have to be above 125% of the poverty level. For 2 people 33k is enough.
