Excuse me, but they do it every day. There are many who arrive upon with a valid visa, but they are turned back.

Yes, it does happen with nonimmigrant visas all the time. There's gotta be a suspicious activity of some sort, though. I don't believe they would send back a normal person going for a genuine trip with nothing to hide or any suspicious activities! At least I hope so!!! That will be me!! lol.

thanks,we are in same situation and i was wondering if we can apply for any kind of visa,did you do waiver packet on your own,or you had a lawyer,thank you so much

I hired a lawyer because you can't really find much info on how to prepare the package yourself on the web. You find a lot of info about the criteria, Matter of Hranka, what you need to have a strong case, approved or denied cases, etc. But exactly what you need in the package, how you presdent yourself and the package at the interview, all of that lacks on the itnernet. You can do it on your own, it's not hard. Make sure you know the law. Not only the INA but also the FAM. Good luck!

when you are talking about presenting the waiver package what exactly do you mean? do you just apply online for the regular b-2 visa and then when you go to the interview you bring evidence showing it was a small crime and such and such. i thought you had to file the i-192, kinda confused. also is there a filinf fee or any additional costs then the regular visa fee?

D (3) visa is not very easy to obtain , it has to be anchored to a non immigrant visa The only waive available to banned CIMT

 

Minuses to some ....having lived in he past in the US, having a conviction or do not satisfy USCIS conditions will be obeyed

 

Pluses ....if the CO recommends you for such visa, they send the request to DC about 80% of the time when CO recommend its approved

One can ask the CO upon applying for a tourist visa about the D (3) the law says if you have aprepared letter to request this the CO should

accept & send to DC almost always denied in this manner

 

They look at reason for your ban, if rehabilitated (if this applies), family ties ,dates you want to be in the US and why

 

The visa is normally issued for a year, but it can be issued for longer if multiple entrances were requested, upon US arrival

CBP questions & decide how much time they will allow you to stay (its imperative to leave on time or it will be revoked)

If for any reason you want an extension you must go into USCIS with documented proof of reason to stay. a warrant is

issued when this visa is jumped

 

One cannot adjust,live or work on this visa...The good thing with multiple entrances and doing the right thing the opportunity

to be with family & friends at times is there especially Holidays
