Hello! I'm getting ready to send off a I-130 petition for my wife. I'm wondering about the Affidavit of Support form I will need to provide before she gets a green card. If I am unemployed and therefore don't have tax information, can I still apply as the primary sponsor but have a co-sponsor provide the required income level?

I am 20 years old, I met my wife in Costa Rica and got married here. My parents came here for the wedding and fell in love with her and her family. Basically, they are not worried about sponsoring her. My father was already said we could live in the house while I search for work and go to school. Is it possible for me to file the Sponsor form saying that I am the primary sponsor, but without money, and then have a form for the co-sponsor (my father) who provides the income level? Also, I don't have any income information for me or any tax forms, nothing. What would I put on my Affidavit?

Yes, you can have a joint sponsor who will provide the financial support, but you will still be the primary sponsor even if you don't make any money. (I'm doing the same thing since we currently live overseas but will be moving back to the states together and living with my family until we get on our feet) But be careful of the domicile requirement, you have to prove that you've kept up your domicile or that you intend to re-establish it on the date your wife will enter the US. Have you never had any income? If yes, then just include a statement with the AOS that says that and any question that asks about your income on the form just put $0. Otherwise, you need to file back taxes so that you can include that paperwork. Living overseas does not mean that you don't have to file taxes, if you made any money you have to file taxes no matter where you are.

It's not an issue if you can or not, you have to. As the primary sponsor you are REQUIRED to submit AOS. B/c you don't have income you need to get a joint sponsor who will also submit AOS.

Thanks! No, I have never had any income. But just to clarify, I CAN send in an AOS with me as the primary sponsor but without a job and without any tax or income information? All I must do is have the co-sponsor also fill out an AOS and meet the income requirements?

Not "CAN." It's "MUST." You as the petitioner MUST send in an I-864 Affidavit of Support. You include a statement that you were not required to file tax returns because your income was below the threshold requiring you to file.

Since you do not meet the financial requirement, you can have a Joint Sponsor (JS). The JS sends in his own I-864.

So, there will be two I-864s; one from you as the petitioner and the second from your JS.

If you don't send in yours, the case cannot be approved. You MUST send in your own I-864 even though you did not have any income; it's required to bring your wife to the US.
