Good evening,

I have filled out the form, but still wondering if i filled the right answer for Part 2 Application Type. I am married to a US citizen, therefore I chose H. Other basis of eligibility. What makes me wonder if i am right, is the fact that most of the people fill out this form after they have been married , right? Why is there no such option? But I never had the fiancee visa, I came as a tourist. Please, help me understand if I did right filling out H. and answering "I am married to a US citizen".

Thank you!!!!

hi

no, the one you have to mark is A, because you will have an approved 130, you have to send the AOS including the i130, there are several forms. you will file concurrently the i130 and the i485 because an immediate visa is available

"An immigrant petition giving me an immediately available immigrant visa number that has been approved. (Attach a copy of the approval notice, or a relative, special immigrant juvenile, or special immigrant military visa petition filed with this application that will give you an immediately available visa number, if approved.)

Thank you!!!

An approved I-130 or other type of petition is required before an I-485 can be processed. Theoretically, they should be filed separately. However, USCIS makes this bureaucratically easy by allowing you to file them to be considered simultaneously. The answer is A.

Thank you, that makes it clearer!!!
