Hello, I had my permanent resident card which expired October 21/11 which was a little over a year ago. I left America because me and my American husband were headed for a divorce and I needed my family. I've got a son now which I don't know how relevant it is but wish to come live in America again with him. What would I have to do?

I wonder if there is a reinstatement policy?

I'm not sure but I think you may need to go through the green card process again. (maybe) I would like to sit back and watch the answers come in. This is an interesting question.

The only way (assuming you are divorced from the ex now) is to try for a Returning Resident visa (SB-1), but I think your chances are slim.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Not going to happen.

Your husband would have to start the immigration process all over and eventually you'd get an IR-1 visa.

The question was if you removed the conditions of your 2-year green card (to get the 10 year one), not if you have been deported/removed from the US.

If you had removed the conditions, you would now have 10-year green card. But you didn't/couldn't do it, so you were left with nothing.

You left without removing the condition on your green card. Your status ended upon expiration and there is no way to get it back.

There is no way for you to live in the US through your son until after he turns 21. A US citizen under age 21 cannot petitions a parent, and thus is not an path to the US for you until after he turns 21.

The only family ties that allows you to live in the US soon is your US citizen husband. He would have to file for a spousal visa.

That's if her son is a USC. She didn't state he was or had claim to it. She didn't state she was still with the USC ex/husband nor state it was his child.

You want to come and live in the US with your son. Are you divorced from your USC husband? You said "headed for a divorce" but didn't state if you were or not.

Your greencard is expired. It's was a 2 year conditional card so you have no status in the US. The only way to return soon would be a work visa, or student visa, or if you ever meet and marry another USC (or if you're still married to your USC husband and he would petition you).

My son is Canadian born. Me and my ex husband are not divorced yet it took a lot to convince him to even do it. Though I've known one of my closest best friends for 3 years while I lived there and we became more. If I had sole custody of my son and his father agreed to me moving what would I have to do?
