Hello everyone,

I wanted to get some advice on what to do. My fiancee's case was approved and sent over to the Kabul embassy. She went through her interview on the second of December. The officer who held the interview handed her a yellow card and did not tell her she was approved or denied was told her case was being put into AP. She was told to provide more proofs of our relationship. I got phone records and skype chat logs for the entire time we have been engaged and sent it over to her. She got an album full of pictures from our engagement party and took it over to the embassy yesterday and still she was told to bring more pictures. I am not sure if there is a reason for asking for so many proofs since everything was approved here and sent over to the embassy with what we provided with out any problems or they are trying to stall handing out the visa for some reason. I wanted to know if there was anything I can do here in trying to speed up this process or all I can do it hand them what they ask for and wait?

Sorry, but there is no way to speed AP. You are lucky that they are telling you what they want. Many people are put into AP and never told what is needed until 9 months or 2 years later. This is usually done after they get a Congressman of some sort to email the Embassy and ask why it is taking so long and what is needed. Many ME countries have Mandatory AP. They could just be telling you this is what they need to buy them some more time to check into her background more. Just keep trying.

Do you send her any money orders or Western Unions? If so, then send that over. Do you pay any bills for her? You may want to just go ahead and get married.

Do she have to come over here first before you get married? Maybe you can have a wedding there and a wedding in the U.S. If they keep asking for more information it sounds to me that they are doubting your relationship. Instead of sending it back to USCIS, they put you in AP because they can keep you in AP as long as they want.

Just because the petition was approved at USCIS does no mean the actual visa was approved. Send them what they ask for or the visa will take even longer to get. There is nothing that you can do to expedite the AP process, you can only wait. My husband was in AP for 9 weeks. Good luck

This is very BAD advice to tell them to get married. The visa has NOT been denied, the consulate is merely asking for more evidence to prove a bona fide relationship. If they were to get married they would have to withdraw the application and start all over from the beginning, and they would still need to send in evidence of a bona fide marriage and relationship!!!!!!!!!!!! To the OP, just give then what they are asking for and hopefully the AP won't last long.

I have sent in all the banking documents with wire transfers to her, I have sent in all the receipts for shipping charges on gifts I sent over to her. I have tried to think of every single piece of information that I could include to prove to them that everything is real but still they ask for pictures. I just don't understand when they have that much information and a handful of photos of us with other family members what more pictures will do. If they wanted to do more research on her so just say the case is approved and that we are placing the case in AP, the thing is we don't know if the case is going to be approved or denied. That's the stressful part of it. I was thinking maybe if I got senators and congressmen involved it might speed up the process for a decision.

My post did not say just get married. I asked the question did his wife have to come here to the states for them to marry. Because the fiance visa is for the intentions of getting married yes? And I did say try to provide more proof like money orders or transfers. Please read my post again.

The purpose of the K-1 visa is to permit the beneficiary entry into the United States for the purpose of marrying the petitioner there within 90 days. If the OP couple were to marry anywhere else before the beneficiary's entry into the U.S., they'd have to withdraw the I-129F petition and file an I-130, thus starting all over.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Very bad idea. Getting married abroad will invalidate their K1 visa and they will have to start again from scratch, pay new fees, do a new process, and will likely be in AP at the end. This can happen even if they have a traditional, non-legal wedding if the CO thinks it may make them married in the law of that country.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I did read your post, thoroughly, you suggested they marry, they cannot do that with a K-1 pending without withdrawing it and starting all over again with an I-130 for CR-1. Before giving people advice you really need to know what you are talking about. The K-1 has not been approved yet and once it is they must marry in the US. To the OP please disregard this person's posts. Just give the consulate what they ask for and hopefully the AP won't last long.

Hi there,

Maybe you should just provide them the out of party I mean personal pictures of you and your fiancé to them. Like if you and her went out on a date in Kabul and took pictures or maybe some instant messages like Facebook or as you mentioned Skype. Or maybe a letter or something like greetings card that you have sent her. I hope it helps and in sha Allah you get the approval. As imam still waiting for my fiancé case approval in California service center. :( I will keep you in my prayers

my fiance also had her interview on December 2nd but the counselor accuses us of being marrried intact we are engaged and accused us of lying . The case is not denied or approved gave my fiance yellow letter told her they will contact her and she is on ap nothing so far plz let me know as soon as you get update on your case. Thanks

It won't because congressmen and senators cannot legally order the VO to do anything....remember, (from Govt 101), Congress is in the Legislative branch and the State Dept is in the Executive branch...which simply means that anyone from one of those groups (legislative, executive or judicial) cannot tell anyone from another branch what to do....period...

My fiancée is out of ap and finally has her visa thanks god. After visiting the embassy three times and an entire album full of pictures and Skype convos along with used up phone cards she got her visa. I pray that all of your journeys will go as smooth as possible and you are with your loved ones very soon.
