Luck is not what is needed. He needs to read through the rules and follow them.

Good point and something I thought of later. :blush: His problems thus far have been related to making trips, committments and spending thousands of dollars without know what he is doing. If that continues he makes his own "luck" and it is not likely to be good.

I know it will look bad and will be gambling to file for I-129F because he is a married man.

He just got back from Nepal after spending hundreds of dollars and can't go back again to get married.

I just spoke with him and he said he is going to petition as fiancee.

Well, let's wish him luck! Luck is not needed. Common sense and a desire to do what is right is what is needed.

If he cannot affort a few hundred dollars to return to Nepal and get married then how will he be able to afford a wife? One thing to consider since money is tight is that the K-1 visa is more expensive than the CR-1. So take the savings and have him go to Nepal to get married and then file for the spousal visa. Can he meet the Poverty Guidelines? Does Nepal accept a co-sponsor for the K-1 visa? Things to consider. It will not be a gamble to file the I-129F as he is a married man; it will be a waste of time and money--money he could use to go visit her and get married. Sorry to sound like a broken record, but all I hear are excuses as to why he cannot go back to visit. The more visits the better their case in the eyes of USCIS.

Am I the only person who thinks getting remarried that soon after a divorce is mind-boggling? There should be laws to make it longer than 6 months.

It could also be said that marrying someone from overseas is mind-boggling, we all do crazy thing for this thing called "love" or finding a partner.

And this will get his fiance'/wife a lifetime ban for misrepresentation. Why on EARTH would you ever suggest that he lie to immigration????????

USCIS checks the dates, yes. Not only that, if he hasn't gone back since his fake marriage date, then the marriage isn't consumated. SO even with the fake date, it's a no-go. Besides that, at any time can USCIS revoke the wife's(well, future wife's) status when it's based upon a material lie. That's gotta hurt 5 years down the road. Especially when the reason is to gain immigration benefits. The immigration adventure isn't over for quite some years, meaning at any stage he's jeopardizing their future together .

Tell your friend to go see his future wife, have a great vacation together and enjoy each other, get married and then submit petition.

How do they check? :o

They check with the properly filed reports of consummation with the local Imam, his Mosque.

It was a religious ceremony, after all.

Nepal statistically = Hindu or Buddhist - a chance at Muslim but the numbers aren't in your favor...

they could have been legally separated for years but just never bothered with the divorce part. I know someone in this exact position. he would lose too much and it would mean dissolving their multi-million dollar business, to buy her out (it's a long story) so legally he is still married. If he were to divorce now and get married again it wouldn't be odd because they've been legally separated at least 15 years.

Ehh..

When the USC hasn't gone back to visit, then fakes/alters date of marriage. Quite obvious that there is NO way of consumating the marriage if they haven't met since before they got maried, and did not even met on their wedding day. How they check? Date of last trip. C'mon Gary. You know that!

Well, lets keep it simple, aye?

A religious ceremony doesn't count for a legal marriage,

but the IV Unit in Nepal will deny a K-1 visa at the interview because the religious ceremony occurred.

He's not legally married, so it's better to go back to Nepal, and legally marry her after the 6 month window,

then (and only then)

file the I-130.

Spending a few hundred dollars, at this point, is miniscule.

He could save up 8 grand over the next 2 months, then go back to Nepal and marry.

Whatever you do, don't lie to the Consulate. That is stupid, man! You will have to lie to cover your other lies. It's a slippery slope, not worth the effort.

Your friend had a religious ceremony in Nepal. He doesn't have a marriage certificate yet. If he doesnt have a marriage certificate, the Government of Nepal will not recognize him as a legally wed couple.

He could get the marriage certificate. Meaning, get married in the eyes of the law and obtain your certificate. You wont be able to use your religious ceremony's date as that would nullify your wedding in the eyes of the US Govt. Approximate wait time for him to bring his wife over on CR1 is from 9 months to 12 months from time of filing.

The k1 is definitely faster, but in his situation, he divorced recently and already fallen in love and marrying again? That is going to be tricky to explain to the CO.
