Evidence needed for visit

In your opinion(s), would a return plane ticket and a still-valid UAE residence visa be enough evidence to prove my husband will return back to the UAE to finish the immigration process? My children and I are repatriating in late Feb and my husband is accompanying us to the U.S. He has a visit visa valid until June 2014. He will return to the UAE to do his interview.

I understand this is frowned upon but it is going to happen regardless of the risk of his being denied entry. I am not moving myself, my two small children and 8+ pieces of luggage halfway around the world without help. My father is sick with cancer and I cannot wait for my husband's interview to happen to return home and be with him.

-11.15.12: NOA2

-28.11.12: NVC phone call - pkg rcvd and case # generated

-29.11.12: Email rcvd with case # + IIN #

-29.11.12: AOS fee paid, DS-3032 email sent

-30.11.12: Lawyer hired to help with particulars of our case

-01.12.12: AOS fee shows as 'paid'

-10.12.12: Email confirmation on DS-3032 received - waiting for IV App Fee to show up

-12.12.12: IV App fee displayed and paid

-12.14.12: IV App fee shows as 'paid'

-12.19.12: AOS + IV packages sent out to NVC via DHL

-12.21.12: Packages rcvd by NVC

-01.07.13: Emails rcvd both AOS and IV - problems with applications

-01.12.13: New apps with changes sent out via DHL

-01.23.13: Email received from lawyer: our case is being expedited by the NVC and Embassy!!!

-02.05.13: Notice of April 1st interview date received

-02.20.13: Leave UAE permanently together

-02.22.13: Begin immigration process anew - Adjustment of Status route

-03.30.13: Notice of April 30th biometrics appt received

Does your husband work? Having an income in his country of residence will probably help more than the return ticket and residency visa. I can't lie though - it's not going to be easy for him. Since it seems he already has a US visa (is it a B2 or something?) he will be dealing with CBP at the airport. But now his circumstances have changed and if you already petitioned for him it's proof of his intent to immigrate. If they don't like the evidence he presents as ties back to the UAE they will send him right back on the next flight. It can't hurt too much to try - it's only money wasted right?

If you were asking if he could get a tourist visa with that I would say probably not. Since he already has one, it'll be up to CBP, and they can be more difficult to predict. Your husband should bring his NOA 2, interview letter or whatever he will have at that stage to show he intends to do things the legal way. I think he has a reasonable chance of being allowed in, especially if he still has a job.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
