k-1 denied,now cr-1

just joined, we went thru the k-1 process and was denied(not bona fide), and they denied my Fiancee b2 visa in the process.Said intending to immigrate and Misrep(p6ci).So now ,Hired Attorney and i am going to china in Feb. to marry and file cr-1 visa.....

Sorry to hear that, probably would need more information on the denial, but sounds like an attorney is a good thing. Get a main stream good one.

Ya, Even with 'an attorney', I suggest a one to two hour consult with Marc Ellis, prior to Filing the I-130.

yea,1 thing that went wrong was i think i may have screwed up on the DS Forms and also she said she had known me for 1 year(at the Interview) and it had only been 8 months and i wasn't at the Interview.As far as the Revoked b2 visa(misrep.),who knows..she had a travel agency fill it out for her and i know she told the travel agency that we had a pending K-1 Petition...so we don't know,but we are more prepared this time,been apart almost 9 months..known each other for over 1 1/2 years and then Marry...with an Attorney to represent us..so we will see..hope we won't need to file a I-601..Attorney says he not think the Embassy will bring up the Revoked B2(P6CI)Visa...we'll see!

1 other thing..Officer at Interview never looked at any of the ongoing relationship proof..all he saw was my 1 visit..not the other 2 visits or photos of me with her Parents..or her in the U.S. with me...my suggestion is Front Load you Petition!

The section of your post I put in bold is by far the biggest issue you now have. I agree with Darnell's suggestion, consult with Marc Ellis. Unless the attorney you hired is well versed in the waiver process and is familiar with tough consulates, your attorney could get in over their head real quick.

April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)
April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

you will need to file a waiver, you were denied for misrepresentation. You need an attorney who is well experienced in this area.
