Hello!

I have a question. My wife is pregnant. She came in on a K-1 visa. She didn't get vaccinations at Medical appt because of the pregnancy and we are apply for her AOS. She won't be able to get the Vaccinations either because:

1. She'll still be pregnant until March

2. She'll be breastfeeding after the pregnancy, can she do it then?

What do we do for this instance? We were looking to send the I-693 in with the AOS paperwork. Send in the AOS and wait for RFE and possibly do it during breastfeeding stages? OR get it done now and have the Dr. check mark the complications (or whatever it said) box meaning she won't have any vaccines done.

Please advise. Thank you.

These are the types of questions that should be reserved for the civil surgeon and asked during the immigration examination. After all, the civil surgeon is a physician, has to follow HHS guidelines, and will have likely seen one or two pregnancies during their career.

Get the exam done and file the I-693 with the rest of the AOS applications. Failure to do so may result in your application being delayed or possibly denied for failure to establish that you are eligible to adjust status.

She will be given a waiver for any shot which is not medically appropriate because of her pregnancy. The civil surgeon will be the one to mark the I-693 as to which shots are contraindicated.

In general the following are not given during pregnancy according to the adjudicator's field manual.

Tdap (Td okay)

MMR

Varicella

Influenza (live/intranasal preparation

If her DS-3025 from her medical abroad indicates in a column to the right that each of these are not medically appropriate, then that form should be accepted without going to a civil surgeon to get the same certification already given by the panel physician. The results section would also need to be filled in to say (x) incomplete. (x) may be eligible for blanket waiver.

Also, having chickenpox excuses the varicella. The DS-3025 would have a VH marked to the right.

Unfortunately, since they went through Juarez, they probably do not have a DS-3025, or it is blank. They will need the I-693.

Ahh...I didn't even look at the country. My bad. Then it's a civil surgeon for them. If she doesn't look obviously pregnant, perhaps something from her OB/Gyn would be good to show the civil surgeon. Maybe even stating he does not recommend the various shots at this time because of pregnancy. To be more clear...the OB/Gyn note is to influence the civil surgeon who must fill out the official form accepted by USCIS.
