Please i need your help.

My bf apply a k1 for me, but he applied another person on 2004 and now he apply for me on 2006. But USCIS wants to deny us because he applied 2 k1 in two years. They request a waiver within 30 days. But he does not know how to request a waiver.

Does anybody know a similar case? Please help us! I don't want they deny us. :help:

My K1 journey:

Aug-02-2006: I-129F sent

Aug-14-2006: Cali service center received

Aug-15-2006: NOA1 (14 days)

Oct-23-2006: touched the 1st time.

Oct-24-2006: touched

Oct-25-2006: touched

Oct-31-2006: Email notification of RFE

Nov-17-2006: IMBRA sent to CSC

Nov-21-2006: touched ------- CSC received IMBRA

Nov-22-2006: touched

Nov-27-2006: touched

Nov-28-2006: NOA2 (118 days)

Nov-29-2006: touched

Dec-06-2006: received approved letter by mail

I dont know much either. Did your bf person of 2004 get to the interview stage ? Seems the government could have issues with him, his gf of 2004, or both. But best wishes to you.

What happened to the 1st girlfriend? Did she get denied? Did he withdraw his petition for her K-1 Visa? If he hasn't done it yet. He needs to get that done first. They will deny your petition if he still has the 1st girlfriend's file floating somewhere.

Once he withdraws the K-1 Visa petition for the 1st girl, he can go ahead and file for you. Good luck with the process. Prepare to explain and answer a lot of questions from HCMC about the 1st petition since this could be a signal and redflag for frauds in the eye of HCMC.

To withdraw his petition, he needs to contact the Service Center where he originally filed her I-129F. Your boyfriend can search the address/contact information based on his STATE of residence and then he can contact them... go here: Service Center by STATE

What happened to the 1st girlfriend? Did she get denied? Did he withdraw his petition for her K-1 Visa? If he hasn't done it yet. He needs to get that done first. They will deny your petition if he still has the 1st girlfriend's file floating somewhere.

they broke up before he met me. I heard that they denied the 1st girl after interview at HCM. And they sent him a letter to close this case in 2005. They need a waiver to explain about his situation. But wen dont know how to write it. and i think it's hard to approve with a waiver, rite? :(

It is a "letter of explanation" and it's not hard to approve.

First thing first, if your USC filed a I-129F on your behalf, but they (???) USCIS(???) didn't approve. Then your USC must find out why and correct the issue. I don't know if you want to sit around doing nothing, waiting for 2 years and start the process again. I do not have any good idea how long you have to wait either. Each case is different!

I believe this waiver is being requested because the USC filed an I-129F petition previously in 2004 on behalf of a different beneficiary.

First thing first, if your USC filed a I-129F on your behalf, but they (???) USCIS(???) didn't approve. Then your USC must find out why and correct the issue. I don't know if you want to sit around doing nothing, waiting for 2 years and start the process again. I do not have any good idea how long you have to wait either. Each case is different!
