1864 sponspor question

My mother is my joint sponsor for my Israeli husband. She also was joint sponsor my sisters foreign husband several years ago. My sisters husband was denied, and has been in court hearings for years. He still did not get a greencard. They live in the US. My husband and I live abroad. My question is: does my mother list my sisters husband in her household? Or does she need to indicate this somewhere?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

This is wrong. Only previously sponsored individuals who are now permanent residents are counted. Why not read the actual question on the affidavit before speculating blindly?

Thank you both. So you think since he never became a permanent resident we don't have to list him? I'd rather not be associated with him if I can avoid it. He overstayed and married after a student visa and has been facing deportation hearings for years. (he has been in the us for around 15 years. His greencard was denied.) but I don't want to leave him off if it is necessary because I want to do everything by the books.

I'm not being rude. I'm advising you how to be certain. That's what you want, right? Any opinion on this matter that disagrees with what I told you is a wrong opinion. "Right" is not a democracy or determined by consensus. I gave you the correct answer. If you want confirmation, look at what the affidavit actually asks.

In short, no, I don't "think..." I know, you don't count him. I know BECAUSE I read the actual question on the affidavit. Get it?

Read carefully. Interpret literally. Answer accurately. It's really as simple as that on THIS question.

If you want to be absolutely certain, since the sister's husband's greencard has not yet been approved, send a letter saying you are withdrawing the affadavit of support. That way you know that even if his greencard gets approved later, you will not be on the hook.

That's right but to be clear on the context, it's the Mother/joint sponsor, not the OP who NEEDS a joint sponsor, who would be withdrawing the affidavit of support, to protect herself, not the "you" who is the OP. AND, regardless of whether her Mother withdraws the earlier affidavit of support, she can NOW be "absolutely certain" that the sister's husband is not counted in Mother's household size TODAY.
