Hey there,

I just got married two weeks ago, am finishing my current semestester this week, and will move to California this coming Sunday. My husband and I are planning to file our AOS package with USCIS next week, and I just have a few questions before sending it off...

1. For each form (I-130, I485, I-765, and I131)we have included all my DS forms (J1) and my current approved I-20. I figured since I have done CoS it is wise to send all my papers reflecting legal stay. Is this necessary? Further should I include the approval letter I got from USCIS showing when and that they have approved my CoS?

2. On I-485 part 3. C it is asking about organizations. I looked at the sample form but it is filed in case of a K-1 holder. I was an au pair from 2009 - 2011 and put my Au Pair agency on there. Is that right?

3. On form G 325-A it says for wife give maiden name, so that is what I did. Do I however have to include my new family name there also?

4. Because we just got married and just picked up our marriage certificate the end of last week, we were not able to add me to everything yet. I just wanted to show my proof here, and ask if that is ok and enough for now, as I understand that by the time of the interview I will be able to add a lot more:

Joint bank accounts and statements showing both our names

Joint car titles (showing my maiden name)

Joint car insurance

Familyplan showing both of our names

Order receipts showing both of our names and joint address

Travel confirmations from the beginning of our relationship until today (flights, hotels)

Wedding invitation showing our wedding date and both of our names

Hall agreement for reception showing both of our names and wedding date

DJ contract showing both of our names and wedding date

Joint netflix account

Bill for wedding cake reflecting both of our names and weddind date

Affidavits by his two sisters and my cousin

10 pictures throughout or relationshoip and our wedding

Is that enough for now? He bought his house years ago, so we cannot add my name to it until we refinance it, and we are planning to add me to all kinds of utility bills after the holidays, same with his health and life insurance, which needs a copy of or certifcate in order to legally add me. So by the time of our interview we would have a lot more. I am just worried we will get an RFE.

Day 06 - 01/08/2013 checks been cashed

Day 08 - 01/10/2013 received NOAs for all four forms

Day 12 - 01/14/2013 received appointment letter for biometrics on 02/01/2013 but completed biometrics the same day

Day 27 - 01/29/2013 received email that our case is ready to be scheduled for an Interview :)

Day 29 - 01/31/2013 received an email that our Interview will be on March 6 2013!!!!!!!!!

Day 33 - 02/04/2013 received hardcopy of interview letter

Day 62 - 03/05/2013 EAD/AP approved

Day 63 - 03/06/2013 scheduled interview appointment - APPROVED

Day 66 - 03/09/2013 I130 & I485 Approval noitces arrived in the mail

Day 70 - 03/13/2013 EAD/ AP combo card arrives in the mail

Day 71 - 03/14/2013 Greencard arrives yay!!!

Hi,

1)

Just a comment, you mentioned you are including all Ds-2019 forms for your J1 status. Did you send evidence that you are not subject to the two-year residency requirement?

Your visa and forms may state it. Not sure if the forms just stating that you are not subject is enough or if you need an "advisory opinion" (which you can request for free but can take up to 8 weeks) is necessary.

I assume you are not subject since they ask in the 485 application.

2) For organizations, I guess you can put your agency, although I think it is meant for more formal organizations. But it won't hurt to put your agency.

3) Yes, if you changed your name you should include your new name wherever forms ask for "other names used".

4) For initial evidence seems enough (for being married only two weeks), as you mentioned it will be expected you take more evidence by the time of the interview.

Those are my thought, hope it helps (although I'm not an expert at all)...

10/16/12 - (Day 14) Received hard-copy of the three NOA1

10/18/12 - (Day 16) Received letter of biometric appointment for November

11/02/12 - (Day 31) Biometrics done

12/20/12 - (Day 79) Interview day .... Approved

12/26/12 - (Day 85) Green card mailed ...

Note that the EAD was never processed.... case number for EAD only showed "Initial Review" ...

Thank you so much. Well the fact that my CoS was approved is evidence that I am not subject to the 2 year rule, as you can only change status within the states if it does not apply. :).

But dont I put my new name everywhere and only put my maiden name where it says "other names used"?
