I received a notice from email and text from USCIS says >> Your case has been accepted and routed to the USCIS National Benefits Center for processing. Within 7-10 days by standard mail you will receive your official Receipt Notice (Form I-797) with your Receipt Number << Is that mean they are processing it already and I just have to wait for decision or it just just something letting me know that they accepted the application already? it's form (Form I-797) and when I checked it from USCIS' site, it's on initial review status...thanks

I know English is not your first language but youhave to try to think. You are sweating really minor stuff that a 4th grader would unerstand. Relax or you will end up hurting yourself

@SerenityNOW - for form DS-230 ( who's named should be on this form? ), is it needed a photocopy of my passport and birth certificate as well or just for my son's? biggrin.png how did you sign the documents? (=

Sorry, I just happened to see this. I was mostly only reading the main stepchild thread, as most of the people applying for IR-2s are there.

My stepson is 16, so he signed his own forms. For a young child, you just sign yourself as "XXX signing for minor child xxx." Several people on that stepchild thread have discussed doing it that way. The rest is the same for everyone else applying for I visas: the visa is for your son, so it's his name. Original documents - his. Photocopy of his bio page of his passport. I don't recall anything being required from my husband at this stage; everything required for the petitioner was already submitted with the I-130 form.

Here is an excerpt from the cover letter I sent (I was the agent on the application, so I sent the letter) - note that some of this is specific to Bulgaria:

To whom it may concern:

Enclosed please find the form DS-230 Application For Immigrant Visa And Alien Registration for my stepson, XXX XXX XXX (DOB XX-XX-1997), and supporting documents as follows:

  • Coversheet with barcode
  • Form DS-230, signed on page 2
  • List of required documents from Bulgaria, from DOS website
  • Translation of birth certificate
  • Certified birth certificate
  • Photocopy of certified birth certificate
  • Translation of court certificate (svidetelstvo za sudimost) from the municipality of Smolyan showing that there is no record of his arrest (issued 01-22-2013)
  • Original court certificate (svidetelstvo za sudimost)
  • Photocopy of court certificate (svidetelstvo za sudimost)
  • Photocopy of the biographic page of passport
  • Copy of translation of consent form that the birth mother, XXX XXX XXX, has had notarized, giving permission for her son, XXX XXX XXX to immigrate to the United States with his father, XXX XXX XXX
  • Copy of consent form
XXX has never been married nor divorced (16 years old), so these documents are not available for him. ...

I won't be on this forum much any more, since now my issues are obtaining a SSN and passport for my stepson [what I have discovered so far: 1). you should wait for the SSN first and 2). a notarized document giving permission for your child to obtain an American passport from the child's mother will be required for your child since he is under age 16 - *might* be required for my stepson since he is still less than 18 years old. Luckily the document we prepared for the embassy included a statement giving my husband permission to apply for any documents related to obtaining citizenship, so I think it will be enough] .

January 7 I-130 sent - APPROVED in 106 days.
Interview - APPROVED 175 days from NOA-1 date
ROC - 2010-2011
October 5 - I-751 sent APPROVED 111 days from NOA-1 date, no interview.
NATURALIZATION - 2012
APPROVED 79 days.
May 9 - Oath ceremony - in Oakland, CA.

Jan 22 - APPROVED 65 days from NOA-1. Never transferred to field office.

Feb 4 - received @ NVC
Feb 26 - Got NVC Case # and Invoice ID #
----------------------------------slowing down the process a little... stepson can't come till nearly July-----------------------------
March 19 - Sent e-mail Choice of Agent, without scan of DS-3032. Paid AOS fee ($88).
April 1 - Choice of Agent information accepted (10th "working day" to accept).
April 3 - IV invoice appeared. Paid IV fee ($230).
April 11 - Sent IV package and AOS package TOGETHER. Confirmed delivery April 15.

April 26 - Case Complete (10th working day)

May 14 - Interview date assigned (12th working day)

June 5 - Interview in Sofia - VISA GRANTED!!!

June 16 - POE @ SFO. No problems. He's a citizen now!

Oct 4 - US Passport received. (SS card received some time in the summer; had to go to SSA office to obtain)

I became a u.s citizen through child citizenship act 2000. I got my u.s. passport this year but I was already here back in 2001 as immigrant. My son is under the age of 18.

It doesn't matter when you got a US passport, you can be a citizen without one, too. It depends when you became a US citizen. If this was before your child was born, you can try to file a CRBA which will make it a citizen at birth. You will not have to file a I-130 in that case.

It's amazing how many questions can be resolved with a 2 minute Google search...

When u become a citizen, ur child will be a citizen too if he is under 18 years old.

That depends if all criteria are fullfilled (i.e. the child is in the legal and physical custody of the USC and in the US with an immigrant visa).
