I became a u.s citizen through child citizenship act 2000. I got my u.s. passport this year but I was already here back in 2001 as immigrant. My son is under the age of 18.

As you stated that you acquired your US citizenship through parent(s), which mean you are not immigrant anymore. Only thing you should know, you will need to provide of proof to relationship to a child (minor). and also you need to provide your Citizenship certificate proven your status in the US unless you were citizen before your son birth by then you will have to get his US passport and join with you in the US Like what stated of other post.

what do you mean it is approved? is it? i think its just a noa1 or something or what is it?

Ah, sorry, that "National Benefits Center" is confusing to me (even though our application was sent there! Our notice did not say anything about where it was routed, it just came with the MSC number instead of CSC...) - I was thinking it was "National *Visa* Center", so it sounded like you received a NOA-2.

That makes more sense - that would have been super-fast if you already were approved.

April 11 - Sent IV package and AOS package TOGETHER. Confirmed delivery April 15.

April 26 - Case Complete (10th working day)

May 14 - Interview date assigned (12th working day)

June 5 - Interview in Sofia - VISA GRANTED!!!

June 16 - POE @ SFO. No problems. He's a citizen now!

I think he (or his son if he is over the age of 14 - didn't see that the OP ever said the age of the boy) will file an I-864W (waiver) since the child will become a citizen, derived from his parent's citizenship. Someone please correct this if this information is incorrect!!!! But our cases are similar - USC father, petitioning for less-than-18-year-old son living abroad - and that is the information I have so far. No tax transcripts required, or poverty level income proof, or co-sponsors. I-864W instructions, includes information about the Child Citizenship Act of 2000. ... The kid signs the form himself as the "intending immigrant" if he is older than 14.

what else did you need to get prepared please? I want to have it ready...I have passport on my list already :D

Personally, I would contact your embassy in the Philippines and find out specifics of what they require. I am going to do that with our embassy to find out exactly what type of document we will need from the biological mother of my stepson so that he has permission to immigrate here. My experience with the embassy is that they require some country-specific documents.

I would expect a DNA test will be required since the child was born out of wedlock, so find out what you can about how that process works in the Philippines (embassy web page is the best place to start - or VisaJourney to the rescue again! Here is a fairly recent discussion need DNA test done in Philippines. I gather you only find out if it is required at the interview stage, so I don't think you can prepare for that, except to know what the process is ...

Photos might help this situation, if you have any from your involvement in the child's life that could be presented at the interview, also see below from the Guides for ideas of what to gather:

Fathers petitioning for a child born out of wedlock must provide evidence that a parent/child relationship exists or existed. For example, the child's birth certificate displaying the father's name, evidence showing that the father and child at some point lived together, or that the father held out the child as his own, or that he has made financial contributions in support of the child, or that in general his behavior evidenced genuine concern for and interest in the child. A blood test proving paternity may also be necessary.

Going through the process currently.

You keep asking about the tax forms, so maybe there is something else about your case that requires you to fill out the I-864 - Did you see post #51? Did you figure out that for some reason your child doesn't qualify to use the waiver?

Your case seems similar to ours (US Citizen father filing for foreign-born child under 18 living abroad, born before the father obtained citizenship). The information I have so far leads me to believe that we submit the WAIVER = I-864W. Just check the second box saying you are not required to file the I-864 because "I am under 18, unmarried, immigrating as the child of a U.S. Citizen...". NO other documents are required with this form. You will sign it since your child is less than 14 years old.

We will be submitting this form in a couple of weeks once we have our NVC numbers. If it is rejected, I will certainly come back here and post why. But others in our situation have been required to send the I-864W. More than one person has sent the whole I-864 package only to have it be rejected and told to submit an I-864W instead.
