Previous tourist visa denial is not going to affect an immigration petition unless you were given some sort of ban. My fiance was a student here in the US for 6 total years and went to get a tourist visa like a year ago and they denied him because they didn't think he had enough strong ties. He most certainly did, but them Embassy rejected everyone that day. B2 visas are very hard to obtain in poor countries. Apparently it doesn't matter whether you've been to the US (or LIVED there) or not. You just have to disclose the rejected visa application on all the forms and mention it if they ask at the interview. Being denied a tourist visa usually means they are unconvinced you don't have any immigration intent but now that you are pursuing an immigration application the set of criteria are very different.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Hello Thx for the reply,,i dropped out of college now and my wife is here with me she spent almost a year with me here our marriage 100% for real,, we are both 24 years old and we have all kind of prrofs to support this but still Casablanca is really hard to go through and the fraud rate is high comparing to other countries..and No i've never been outside my country before but my worries are only my previous application that might effect my current one ( k3 )

He did specify age , and that he's being petitioned for immigrant visa. OP since you and wife live together there I'd say stop stressing if you know your marriage is real

and get your proofs together, even though its a hard consulate just be truthful and know that you were honest on your visitor app. Best wishes on your journey

Since only the I-130 was filed, the process that was started was for the CR-1 visa by default.

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Everyone im deeply thankfull and Greatfull for all the infos you guys gave me,,also i thought all this time im on k3 visa but apparantly it ain't an option anymore so i guess im on CR-1 now by default as ''Penguin_ie'' and '' Jihana '' said. Thank you everyone for the infos and the support..

REd Flags ?? no not that i know of we have been married for almost two years now we dated for a year ,,we are both 24 years old we are both college students ,,the USCIS approved me June 2012 and we had to look for a sponsor because my wife (doesn't meet the income requirments ) we found one,,sent everything ,,paid everything,,, ,,no red flags no criminal records,,we know a lot about eachother even the tinyest lil details,, and she is currently living with me in Morocco right now ..as soon as we hear from the NVC i will post my visa status with the interview date..the only concern i had is me being rejected a tourist visa in the past and now here i am asking for a K3 ,,im just worry that's all.. and by the way Thanls a lot for taking time to answer my question ( Canadian_ wife ) .

To answer your question, no, a previous denial of a visitor visa will not affect your current petition. The one thing I will tell you, the k-3 visa is obsolete and rarely,if ever granted anymore. They will close that petition and process the i-130 for cr1 visa, assuming your wife filed an i-130 petition on your behalf.

I did not understand your initial response but as I read more it is clear to me. My husband was denied a visa and shows proof as the reason for his denial. You do not have to worry about your denial. It will not affect the visa in which your petitioning for now. As long as you have nothing to hide and you have all required documents to support that you will be fine. You can understand the cautiousness from consulates. I am a USC and student who is unable to support my husband but we do have a joint sponsor. Your doing everything correct. Just relax..Well try to relax. :thumbs:

Has your wife been living with you? or staying with you while visiting? You mention that she came on 3 visits...if they are 3 extended visits, or did she actually have residency in Morocco?

1 st visit : about 3 months ( sept 16 to Dec 9th 2011 )

2 nd visit : almost 3 months ( march 3rd to mai 22nd 2012 )

3 rd visit : Sept 13th 2012 and she's not coming back till i get the approval

So that might be good that she stayed over 6 months in Morocco since we got married and also there's the passport stamps .
