Hello VJers,

Here's what happened. My priority date is April 2011. My wife is a LPR. I got a letter from NVC on last week of November stating my case has been completed and transferred to my home country embassy. It also states my IV interview date has been scheduled for January 8, 2013. They have also provided a checklist of documents required for the interview where most of the documents they stated have already been submitted by me (marriage certificate, birth certificate. etc). I have scheduled my medical exam for third week of December 2012.

I was just wondering how did I get an early interview date when my PD is not even current. I have a mixed emotion, not sure whether I should be happy that I got an interview date, or be scared that they might say "Oh there's been a mistake". Please provide me with your insights.

Contact NVC ASAP. I have a friend who also got an early (waaayyyy early) interview because her F2A paper got mixed up with the IR/CR batch. She did her medical and on the day of her embassy interview the consul told her there was a mistake. She was not able to refund the medical fee of 9,000+ pesos. Time, effort and money wasted. :ph34r:

1) Ensure your wife didn't naturalize and upgrade you from F2A to IR-1/CR-1 (visa for USC spouses).

2) Ensure your priority date is correct.

3) Contact the US embassy in your country. Whether by phone/email you need to have your case number, category, petitioner's name and your name on hand or included in your message.

If your country isn't China, India, Mexico or the Philippines then you are grouped under Worldwide in the visa bulletin. So even if you only have one F2A candidate in your entire country, you still have to wait until the Worldwide category is current with or about to include your PD before you get packet 4 (which it appears you may have mistakenly received).

Maybe your case completed on April 2011, Because it's impossible they will send a letter, unless there is something changed with the status of lpr become citizen. Or if the new bill passed all the way. So you are the first one who is getting a visa without pd . I wish so, anyway good luck happy interview!

The friend of my mine whom I mentioned above became too ecstatic and excited when she received the I/L. She didn't think about calling and re-confirming it to NVC although she knew that her PD was not yet current.

Errors like that can happen, I couldn't believe it at first either. Error may pass NVC unnoticed but there's no way the Embassy/Consulate will give you a visa if your PD is not yet current or there has been no upgrade to IR/CR1.

I hope OP called NVC to clear things up.

Hello friends,

Super sorry for the late response. My internet had been down since the last time I posted my problem. Add the long hours of load shedding (power outage) in Nepal. Anyways let me add few more details. My wife has not upgraded from LPR to USC. She is still 2 more years away from applying for citizenship. I had been in the US for last 7 years under F1 visa. We have been married for the last 3 years (after she became a LPR). We got married in the US. I completed my grad school in the US, applied for jobs but luck didn't favor for H1b. I came back to my home country couple of months back.

I am too scared to contact the NVC or US Embassy to confirm my interview date. I know that the worst case scenario is they will tell me during the interview that my PD is not current and that I will have to wait. If I contact them now and tell them my situation, they will obviously say that there has been an error. So I am thinking of taking my chance and go for the interview and see how it goes. If they mistakenly scheduled my interview date, then I will keep my fingers crossed and go for the interview. There is very high probability that I will be denied, but I have no choice.

I contacted my attorney in the US who had been seeing my case when I was in the US. He is also the registered attorney of record for my case. I asked him about this as well. But he just sent me a one liner answer saying take copies of all the documents you submitted during the interview. I will again be sending him an email and ask him what his opinion is. I will keep you all posted. Once again I apologize for responding late.

I doubt the CO will issue you a visa because your PD is not current yet.

I would say it is good to contact NVC and ask the details.
