Possible Divorce with ROC filled 5 months ago

Hi guys,

I have been married for 3 yrs and 4 months, I love my husband to death. I forgave an affair that he said he ended, but now he wants a divorce because he is in love with the other woman. I will give him divorce, but i don't know how to handle my ROC. I have NOA dated July, 21 from VT Center. I do think i need to get a lawyer and try to maybe stop this application and file again once the divorce is final. I would appreciate some advice. Thank you!

Timeline

You can have your filing changed to a waiver filing, there is no need to refile or pay the fee again.

You can either change it now, or wait until the divorce is final, unless your husband writes to withdraw his support.

There is no need to do anything until the divorce is final, unless he writes to USCIS withdraws his support.

Thank you Vanessa&Tony! You gave me some useful info. I did not know you can change the filing to a waiver.

I just do not want any troubles with USCIS, he is the one saying he will file for divorce.

I will be making an appointment to see a lawyer as well possibly, sometime next week.
