2 questions on DS-230, please help

Hi. I'm petitioning my parents. Do they need to send their marriage certificate? Also in question 41- (have you ever been arrested...of any offense or crime) my dad was arrested in Los Angeles twice back in 2001 for driving without a license. Is this considered an offense or crime? Should he mark YES and explain? Since both don't live in the US any longer, how would they obtain their police certificates? are they required?

I need your advise. Thank you
