I-130 for my brother approved six(6) years ago...

Hi Everyone,

I filed an I-130 for my brother in 2006 and was approved. It has since been sitting with the NVC of the State department. It is one of those relative categories that have to wait in line for 10years or so until a visa becomes available. I have also read and heard about how one cannot even get a waiver or get it expedited because that visa is regulated by law. I also heard that even if one gets their Congresswoman or Congressman involved, s/he can not be of any help because of this law.

I just wanted to throw this issue out here in the forum to see who's experiencing this same waiting game. The reason is, I really need my brother here to help me take care of our ailing Mom after our Dad passed away last year. I also want him to come over to work and have a better life for himself in order to take some financial pressure off me. The most over-riding reason is that I genuinely miss him as we have been very close all our lives, and want to see him become successful. Even though we talk regularly, I haven't seen him in a long time because I can't afford to be travelling any longer.

Any advice or suggestions? Thanks!

There are lots of other families with similar situations. Sick mother. Sick father. Sick sister.

There is no way to expedite your brother's case. It would not be fair to all the other families in front of him.

Everyone wants a better life for his/her family. Every person in front of your brother is waiting to be with his/her family too.

There is no way to bring your brother over faster than other brothers and sisters who have been waiting longer than him. Be patience because that is all you can do. There is nothing in the law that will make it faster for him. He has to wait in line like every other brother or sister.

There is no quicker way, though it may be worth your mother filing a petition too- it won't speed up your petition but in case something happens to you (or if you are from Mexico or the Philippines, where the waitingtime for sibling petitions is way longer than 10 years).

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

There are lots of other visa types,Investment or Student come to mind.

An investment visa requires hundred of thousands of dollars.

A student visa requires tens of thousands of dollars.

While both are possible paths, the financial requirements puts them out if the reach if all but the rich.

NATURALIZATION

02/25/2014 - Eligibility date.

03/03/2014 - N-400 package mailed.

03/11/2014 - Check cashed.

03/14/2014 - NOA received.

04/09/2014 - Biometrics.

04/28/2014 - In-Line for Interview - 6 hours later Interview Scheduled!!

05/02/2014 - Interview Letter received. (Mailed on 29 April)

05/26/2014 - 3 year anniversary.

06/02/2014 - Interview. PASSED!

09/11/2014 - Oath Ceremony.

09/16/2014 - Updated driver licence and registered to vote.

10/08/2014 - Updated Social Security

10/14/2014 - Applied for U.S. Passport

10/27/2014 - U.S. Passport arrived in mail (13 days - DID NOT expedite)

10/30/2014 - Naturalization Certificate arrived in mail (was not folded)

MY IMMIGRATION JOURNEY IS OFFICIALLY FINISHED!!

To give a full answer of any other possible family based visas we need to know , what country he is from , how old is he , is he married, what is your mothers status in the US.

This will not be over quickly. You will not enjoy this.

My mom is USC. My brother is 29 and not married. Country is Ghana where he will have process his visa, and where he currently lives.

I know he or we have to wait so at this point that's what I have resigned myself doing. And for sure i do not want or expect him to cut anyone in the waiting line as someone said. Just thinking or seeking advice of other ways his process can be speed up. Thank you for the good feedback!

You are at least not waiting the longer waits such as 24 years. The adult child of a US citizen is usually shorter but you have already worn some years off the wait through the sibling path so that is no longer true ( also he is free to marry with a sibling petition ) Short of more costly visas like student you will just have to wait.

This will not be over quickly. You will not enjoy this.
