Hello,

We have a question on the EAD/AP combined card renewal process.

I may have posted this in the incorrect forum section.

We applied for AOS for a family based visa (K1) in October 2011.

We also sent in the applications for EAD and AP at the same time.

The AOS case was transferred to the California Service center for processing in November 2011.

the Biometrics appointment came quickly afterwards, and the EAD/AP combined card came on 12/27/2011.

Currently the AOS is still pending , we have made inquiries and have a congressional inquiry pending,

as we seem well past normal processing times for a family based AOS.

The issue is her EAD/AP card expires 12/26/12

and so does here drivers license (since the state only issues them the term of the EAD)

We expect the Green card to be approved at anytime , or at least and interview.

Yet the way things are progressing , it seems we need to file for EAD/AP renewal before her card expires.

When I read the USCIS regs on fees, it seems confusing whether we need to pay the combines filing fees for the renewal.

In family based visas still pending it seems to imply you do.

in another section speaking about the combined EAD /AOP cards like she has it states clearly you do not, only need to file for renewal, no fee.

Has anyone been in a similar situation and have a concrete answer for this?

I have had no luck with calling the USCIS

(yes i know its just a contracted call center and they only look at the same information we do on the USCIS website)

12-19-2012 Notice from USCIS re:Inquiries- stating app in standard review

2-01-2013 AOS approved (15 months)

2-05-2013 received card

Make an appointment with your local USCIS office (info pass appointment) Bring everything you have. They should be able to get her an extension.

Worst case, since it is part of a pending AOS, there are no fees for a renewal. If you have to send a renewal, attach a copy of the NOA1 for the I-485 and a copy of the previous EAD/AP. The receipt (NOA1) for the renewal would be your extension to continue working/traveling
