Hi,

In 2006 I successfully navigated my way to a green card (with a lot of help from the folks on this site). My wife and I moved to the US and lived there until June 2011. My job was coming apart at the seams and with the economy and my age it was clear I wasn't going to find anything quickly. An opportunity came up in Canada where we had lived before we moved to the US (she is a USC but had Canadian PR status).

Last week we were headed to Seattle to pick up visiting relatives. I was detained because I had not officially abandoned my status in the US. I was taken in and signed an I-407. To make a long story short my green card had been stolen - and reported stolen prior to my departure from the US. I signed the form and was admitted to the US no problem - total delay 45 minutes or so. Have even been back to the US since.

My wife and I want to go back to the States. She misses her adult kids terribly. And frankly I miss the US just as badly. So, I was just as pleased to sign the I-407 and clean up my previous status. Now I am hoping there is nothing preventing me from re-applying asap. I know how ridiculous this must sound but we want to go back.

My questions:

1. am I right that signing the I-407 is a good thing and will assist me in not having my new application delayed?

2. will my having had a previous green card help or hinder or have no effect on a new application?

3. is there any simpler way to go or do I just need to bite the bullet and submit the I-130?

4. if I submit the I-130 will I have trouble crossing the border?

5. if I start the I-130 and find an employer willing to sponsor me with an HB1 visa, will my I-130 application complicate things?

Any assistance and advice would be greatly appreciated.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

You will have no problems visiting on a pending 130. Currently sitting in Illinois with my husband who is pending.

You won't be able to get a work visa while pending an ir1

Someone is welcome to correct me on that though as I'm thinking that's what I read but it's early and I've barely slept in days.

Bite the bullet, if there was a simplier way we'd all be doing it.

H1Bs are not immediate, file the I130 and go with the immigrant visa, which is what you want anyway

KDH - the work visa question is one of my biggest. There seems to be contradictory opinion on that one. Where did you get the information that led you to that determination. I appreciate the help.

Incorrect. You can have different kinds of petitions pending at the same time.

Petitioner LPR upgraded to USC June 22, 2012
August 22, 2012: case complete
October 18, 2012: Interview (APPROVED)
October 26, 2012: Picked up visa from DHL (delay caused by Sandy)
December 15, 2012: POE Atlanta....................became USC July 2016!!!!

Mothers' Journey (My sister is the petitioner)

September 10, 2013: Sent I-130 (UPS next day service)

September 12, 2013: Received text to confirm delivery

September 16, 2013: Received NOA 1

March 22, 2014: Received NOA 2

April 8, 2014: File Received by NVC

May 26, 2015: Interview (approved)..........now LPR (delays caused by 2 RFE)
