Received RFE notice today on the AOS but I already knew we were going to get it so it was no surprise!

So sorry to hear that! Was it an electronic or a hardcopy notice? Do you know what it is for? I saw another December filer on the board get an RFE for affidavit of support and I'm now slightly paranoid even though I believe I have that covered...

I just happened to check the online status today and saw that an RFE was issued today. So we should get the hard copy by next week, I guess. I'm 100% positive it is because when we filed I didn't make enough money but I recently landed a new job so it won't be such an issue anymore. I think the other issue might be that I was working overseas for the past two years so my taxes show in zero for last year.

I'm just hoping that the RFE does NOT affect my husband's EAD because we wanted to get that expedited due to possible job offers on the table...

We received the biometrics letter 10 days after our AOS/EAD was sent. It was scheduled for two weeks later than the day that we received the letter. So you should get the letter for biometrics in the next week or so. I don't know if we got ours on the average timeline, but we live really close to Chicago.

We received the biometrics letter 10 days after our AOS/EAD was sent. It was scheduled for two weeks later than the day that we received the letter. So you should get the letter for biometrics in the next week or so. I don't know if we got ours on the average timeline, but we live really close to Chicago.

My package has been delivered on December 3oth (Sunday?? huh) and I talked to USPS they said, its p.o.box so it might have delivered on Sunday 10-30PM.. lol

BTW I tried to Intercept the mail as I found out that I selected wrong option on I-864 part 2. but its delivered already.

so can't do anything else.

Hope you get the easy way (i mean not a lot to submit)

Don't worry... I already knew it was coming haha so I am not bothered by it, just wish it wouldn't affect the EAD (I'm pretty sure it does, so I'll have to try to send the RFE back ASAP)!

I already knew what it was going to be for (need to provide evidence of salary for the affidavit of support and I just got a new job so I will able to provide them with that... although I will NOT have tax returns because my taxes last year were in zero due to living overseas). Can I provide employer letter and pay stubs only? Will that be sufficient?

I think you will need to send them a complete tax return or IRS tax transcript to prove that you filed. It doesn't matter if you made any money in the US or not. Documents such as pay stubs and letter from employer would establish you ability to support your spouse based on your current income. You have that covered! However, tax return is to establish that you filed taxes as is expected of all citizens of the US, both at home and abroad.

You are exactly right about "I-864 income eligibility requirement" and "all citizens must file tax returns" being separate and the fact that each need proper documents to prove. Also, note that if the US citizen's income (at home or abroad) is zero (unemployed) or below the specified limits, they are not required to file a tax return:

"As a United States citizen, you must file a federal income tax return for any tax year in which your gross income is equal to or greater than the applicable exemption amount and standard deduction."
