Got an Interview date today! :)

we are also done with the biometrics (exactly a week ago) and now waiting for an upgrade on our USCIS website status (still acceptance for I-485 and initial review for both I-131 and I-765)

Our story: K1 -> AOS -> ROC -> Naturalization (2012 - current)

Not necessarily. My bio was done on the 7th of January but nothing since then on EAD or AOS. It all seems to be random.

I-129F Sent: Sometime in February 2012

I-129F NOA1: 13th February 2012

I-129F NOA2: 6th June 2012

P3 Received: 26th June 2012

P3 Sent: 16th August 2012 (delayed by police check)

P4 Received: 23rd August 2012

Visa Interview Date: 9th October 2012 - Approved!

Visa Received: 17th October 2012

POE: 29th October 2012 - DFW - In country!

SSN: 3rd December 2012

AOS filed: 6th December 2012

Bio Appointment: 7th January 2013

I know that those adjusting from K-1 usually have longer wait times than those adjusting from other visas and typically get waived for interviews. We should be getting EAD/AP approvals for December filers in the next few weeks though.

Nothing new here ... It's kind of frustrating to know that we were already in the Testing & Interview stage but due to the move now back to step one :huh: Maybe next week will bring some news.

Still no movement on my AOS but I just checked and my EAD application now has moved to Decision and says was approved today :) Just have to wait for whatever they have to mail out. Do you get a card or something for EAD?

yeah i think you'll get an EAD card.. Looks like a lot here are starting to get their cases updated. Too bad Im not of them. :(

Hey all - quick question (although I asked this on the main forum and no one had answers so I hope someone here can help me out!):

I start my new job tomorrow and currently have only a job letter from my employer. I need to respond to the RFE for my husband's AOS by the end of March, but I really was hoping to do it ASAP because I want him to get his EAD as quickly as possible. But I don't know if I should send back the RFE response with: a) new I-864 with new income (it is above poverty level), b) employer letter, and c) tax information (again). OR if I should wait until the end of February when I will have two paystubs to send with the previous mentioned items. Just as a note, our RFE was for insufficient income so I want to try to prove that I am now CURRENTLY making enough money.

Any advice?

I would suggest waiting for one or two paystubs to provide enough evidence of your current income. That along with a letter from your employer should help establish your ability to support your husband. I am not sure if you are required to send in what you already sent but I think it is safest to fill out a new i-864 and send it with tax information and the new supporting documents from your new job. Something I might suggest, depending on how well you get along with your boss (I understand it's a new job, so circumstances may vary), is to get your boss to write a letter (with company letter head) to USCIS with the following information:

  • When you started
  • How many hours per week you'll work
  • how much money she guarantees you will make this year

Reason being is if your employer promises you'll make X amount over the poverty line, USCIS will sometimes honor it.

I'd wait for the 2 paycheck stubs to send along with other documents you have. Like others have already advised you in your other threads, you only have 1 chance to respond to this RFE and you'd want to do it correctly.

Just got a text/e-mail notice from USCIS. January the 30th received one saying EAD approved. Today....EAD card production!!!!!!! Still nothing on an interview, any ideas why? Also, just spoke to my lawyer. Says at this stage RFEs are VERY unlikely.
