hello everyone,

I need your help on my case right now.

I came to Chicago, USA through K1 visa in August 2012, and then we get married, however we did not make any name change till now.

We filed AOS and i just got my EAD( Combo Card) last Friday, now I would like to apply for SSN#.

However, my EAD and 1-485 files are all using my Chinese name ( both first name and last name), so does our Marriage Certificate. My question is:

Can I use married name ( English first name and my husband last name) when i apply for SSN#, meaning make name change and apply for SSN using the new name at the same time? or i need to make name change first otherwise i can only apply for SSN# with my Chinese name?

Plus, since my GC is not issued yet, can I make name change and notify USCIS about it so the GC will show married name? how about EAD then?

And, if SSN and EAD both show my maiden name, can I open joint bank account with my husband? can I be under his health insurance?

I am so confused right now, please help me!!!

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Please do not post your question in more than one thread - it will actually delay you getting responses. You need to be patient and wait until someone posts a response. There are many knowledgeable people on this site but they all have their own lives to live and may not read your post until several hours later. You have been a member for only a few short hours yet have already posted your question in 5 different threads. Please be patient and some one will answer your question soon.

For general information, your name on your SSN needs to agree with the name USCIS has on file for you. If you applied before you were married, then it would be in your maiden name or the name that was on your K-1 visa. If you apply after you get married and file your for AOS with your married last name, then you should be able to take your marriage license into the Social Security Administration along with your passport and visa and be able to get a SSN in your married name. If you applied in your maiden name and request your SSN in your married name, then USCIS will not have proof of your married name on file and your SSN may be denied until they can verify the correct name, or you may have trouble proving that you are the same person. You definitely want your green card and your SSN to have the same name. Your EAD and your green card will be issued in the name you used on the AOS file. I am not sure if you will be able to change it at this date. It will depend on how far along they are in the process. Since they have already issued the EAD they may not be able to accept a change at this time.

The best suggestion is for you to make an Infopass appointment at your local USCIS office, bring along the necessary paperwork and a new I-451 application completed with the name that you wish to use instead of the one you filed with, and see if they are able to substitute the original application with the replacement one. I don't know if they will or can or if they will charge you extra money to do so. You can make an Infopass appointment by going to the USCIS website at: http://www.uscis.gov , then in the left hand side there will be an option to 'make an infopass/ appointment". Click on that and follow the instructions.

We used my wife maiden name on the Drivers License and Social initially. At our AOS interview we asked the IO to change it to her last as a middle and she did. When the green card came with her married name etc., we went to Social Security and changed it for no charge, they will then issue a new card with the DHS stamp and in the new name. We then went to DMV and bank to change those.

In Arizona its hot hot hot.
