MJ is illegal by federal law, yet Obama will ignore the law because CO and WA have legalized MJ in those states.

  1. 1. If SCOTUS rules that gay marriage bans are illegal, should Obama ignore the ruling in states that have voted to ban same-sex marriage?

    • Yes. If he can ignore federal law when it comes to his voters flouting it, then he should ignore it when it comes to RWN's flouting it.

Federal law supersedes state and local laws, as long as the federal courts don't rule otherwise. However, since the executive has all the cops and all the prosecutors, it is up to them to enforce the law, or not. As the founder of the Democratic Party said, "John Marshall has made his decision, now let him enforce it."

Of course, WA and CO may want to take notice of California - Feds are regularly shutting down pot clubs and busting growing operations. If you were engaging in an illegal activity now made legal, you need to do all those things a legal enterprise would have to do, like pay your taxes, comply with EPA regulations, zoning restrictions, etc. Now you become high profile if you do, and a criminal if you don't. Either way, the Feds will continue to harass you.
