I need some advice on my current AOS application based on spouse (K-1 Visa).

Current Timeline:

May 24, 2012: AOS application received at National Benefit Center in Missouri

May 29, 2012: Notification of receipt

Jun 1, 2012: Appointment Notice for Biometrics on Jun 29

Jun 13, 2012: Transfer Notice, case was transferred to California Service Center

Jun 29, 2012: Biometrics taken at USCIS Boston

Aug 6, 2012: EAD was sent through USPS

Aug 9, 2012: EAD work permit arrived in the mail

Today (Dec 13) has been 183 days since my case was transferred to California. Should I ask for inquiry by calling 1-800-375-5283 and going into "reporting a problem" with my case? Or should I apply for e-request (service request)? Or should I go for infopass? Any advice is appreciated as I really have no idea what's the current status of my application.

Side note: I have a friend whose friend's wife sent the AOS application in Aug and already received her green card right now. So, I am wondering why mine is taking so long. I don't even know if my interview will be waived or not.

Thanks.

Report a problem. Ask to be transferred to a tier 2 operator because you're outside of normal processing(180 days from transfer).

The duration of AOS depends on which visa you're adjusting from, if the case is transferred to CSC(and if it'll be sent to a local office after that).

K1 process, October 2010 > POE, July 2011

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

From filing I-129F petition until POE: 285 days

Click timeline or "about me" for all details.

AOS process, December 2011 > July 2012

EAD/AP Approval took 51 days from NOA1 date to email update. (77 days from filing until EAD/AP in hand)

AOS Approval took 206 days from NOA1 date to email update. (231 days from filing until greencard in hand)

From filing I-129F petition until greencard in hand: 655 days

After the service request was submitted, on Dec 20, USCIS reported the following on my case:

"This notice acknowledges receipt of your status inquiry concerning your pending I-485 application. We recognize your interest in a final adjudication on your pending application and are aware of the difficulties caused by any delay in processing. The California Service Center is committed to processing this workload, and will be making every effort to adjudicate your case in an expeditious fashion as soon as available under our resource constraints."

Does this mean I just have to wait? Or will it be worth the trouble of going into info-pass to speak with a USCIS person directly? Please advice soon. Thanks!

My wife is running along the same timeline as you as far as date forms submitted, etc... She even received the same letter you received which basically says that they are working on it.

We did do the Info Pass appointment. They told us nothing. It's all a waste of time. The only thing I am doing now is getting my Congressman involved. Other forums have indicated CSC takes a long time. That is all I know. We are in the same boat as you.

I see. How do you contact your congressman? By phone? How do you know which congressmen to contact? And did you simply inquire for expediting the process of your wife's visa application?

You just go online and find your congressman and senator's mailing address. The U.S. citizen should inquire on your behalf but you should both fill out a permission form. I would include all related docs and a timeline of your case and also related case number and A number.

Good luck
