Getting a Drivers license in Texas

Guys I'm going to drag this topic back up as I am having awful trouble with the dps and would like some help if anyone can figure this out....

So my i94 expired on dec 24th.... I went to dps early jan with my I-797 for aos. The lady said yep no problem I can use it etc. we went through the processing of it all, had my picture taken etc and I was thinking great, finally I can book the road test. Then, right at the end, computer said no and I was told in should go home and wait for a letter explaining the hold up.

So, I got my letter and it says that my I-94 couldn't be verified! I guess this is because it is expired, but that's not my fault and I can't change this fact.

So I went back to the dps and they just tell me that they can't do anything Neil the computer lets them, she showed me the screen and next to my A number it just says "pending".

So basically DHS are trying to verify me but they can't because they see my i94 is expired. It's driving me nuts! I just want a damn license and I'm being made to feel like I don't have my immigration docs in order. Which I know I do. I have a valid noa1 which they as they accept, so why won't they? Is there anything else I can do?

I should have my advanced parole doc through in the next coupe days, I'm told that dps accept that also, but I think that when the computer asks for all the numbers such as my a number and I-94 as well as the sveis for advanced parole, it's still going to reject me as it sees my i94 is out. Even though its impossible for me to fix that because I'm k-1. Grrrr

Its unfortunate but thats how the state laws are written, state law makers have not left any special provision for people immigrating legally.

As per the law they have made it very simple only issue the DL until the status of the applicant is valid, your status was valid until your I-94 was valid.

Now you are pending AOS which is not a valid status for DPS as they do not know which way your AOS will go.

Once you get your conditional card you will only get 2 yr lic, after that you will file for removal of condition and USCIS will send you an extension letter for another year so you will have to go back to DPS and get another lic with one year extension.

After all this you will get your 10 yr card and thats when u will have to go back to DPS and they would issued u a 6 yr DL.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Your timeline says your EAD has been approved. It will have an expiration date on it--January ?, 2014. With that, you should have moved beyond the I-94 issues, which was all you had with an expiration date on it before. You've moved up a step with an unexpired and dated document, and will hopefully get a license this time.
